Title
Approving an ordinance on second reading with a caption reading: AN ORDINANCE OF THE CITY OF PFLUGERVILLE, TEXAS, ANNEXING FOR FULL PURPOSES, TWO SEPARATE TRACTS OF LAND CONSISTING OF APPROXIMATELY 84 ACRES WITHIN THE SH 45 RIGHT OF WAY, OUT OF THE PETER CONRAD SURVEY NO. 71, ABSTRACT NO. 200 IN TRAVIS AND WILLIAMSON COUNTY, TEXAS TO BE KNOWN AS THE SH 45 RIGHT OF WAY ANNEXATION (ANX1106-01); EXTENDING THE BOUNDARIES OF THE CITY TO INCLUDE THE LAND; BINDING THE LAND TO ALL OF THE ACTS, ORDINANCES, RESOLUTIONS AND REGULATIONS OF THE CITY; APPROVING A SERVICE PLAN; AND PROVIDING AN EFFECTIVE DATE.

Summary
The proposed annexation is an infill annexation which consists of two tracts in the SH 45 right of way. Tract 1 consists of 50.5 acres and includes the west portion of the Heatherwilde bridge over SH 45 and extends into Williamson County. Tract 1 is surrounded on the north, east and south sides by Pflugerville City Limits. Tract 2 consists of 33.6 acres and includes property located generally north of the Highland Park North subdivision and surrounded on all sides by the Pflugerville City Limits. The areas surrounding the proposed annexation tracts were annexed into the City between 1997 and 2003. The subject area is in both the Pflugerville and Manville service areas for water and in an undefined service area for wastewater. No utilities are required to serve these areas as they are TxDOT public rights-of-way. The Police department will be able to patrol the areas and provide services as needed. No additional operation or maintenance services are required. Staff learned on August 30th that the Department of Public Safety's (DPS) contract to work the toll roads, including those through Pflugerville, expired on September 1, 2011. This leaves the responsibility to the City of Pflugerville unless the contract is renewed.
