Title
Approving payment in an amount not to exceed $140,000 to Wastewater Transport Services LLC. (WWTS) for the provision of pump and haul services pursuant to the Development Agreement regarding the Meadowlark Preserve development.

Summary
On October 11, 2022 City Council approved a resolution authorizing the City Manager to execute a development agreement for the Meadowlark Preserve development. Section 2.15 of that development agreement indicates that the City would complete the "Regional Lift Station" by June 31, 2024 if the Developer had finished their off site improvements, but if the City had not finished the lift station then the City would pay for pump and haul collection and disposal of the wastewater.

The lift station in question is the Cottonwood Lift Station. Notice to Proceed (NTP) on the lift station project was issued on 1/6/2025. Original substantial completion and final completion dates were 8/18/25 and 10/13/25 respectively. There have been a number of delays to the project resulting in multiple change orders.

In addition to the lift station, a force main and interceptor are needed. The NTP for the force main and interceptor project was issued on 6/30/25.

With all current change orders considered, the substation and final completion dates for the project were June 29, 2026 and August 24, 2026 respectively.

The pump and haul began in December 2025. On February 24, 2026 City Council approved a PO not to exceed $330,000 which was based on staff calculations of pump and haul costs to get the project to substantial completion in June. That amount has now been reached and based on the current status of the project in the field staff is estimating that an additional $140,000 will be required to get the project through to pump activation. This will bring the total PO amount to $470,000.

This item is supported by the Residential and Node Development pillar of the Strategic Plan.
