Approving a professional services supplemental agreement with ESP Associates, Inc. in the amount of $184,537.32 for professional engineering services associated with Kelly Lane Phase 3 Roadway Project, and authorizing the City Manager to execute the same.
Summary
This agenda item requests approval of a professional services supplemental agreement (PSSA) #5 in the amount $184,537.32 for ESP Associates, Inc. covering the additional costs associated with working on the roadway and drainage revisions, utilities and county coordination, increasing scope to include additional services such as adding illumination design and electrical services at each of the four roundabouts. This also changes the contract to a Lump Sum for the Kelly Lane Phase 3 roadway improvements project (CIP# TR2001).
Prompting PSSA #5 is the extra time and efforts need to accommodate the additional time and efforts spent on the new metes and bounds on the project and for Manville Water's iterative design, and additional level of efforts not accounted for in the previous PSSA.
This PSSA also includes illumination design which was not previously included in the scope of the project. Additional electrical service will be added at each of the four roundabouts similar to the roundabout found on Kelly Lane Phase 2.
This PSSA also will change the contract with the city from Time and Materials iterative design contract to a Lump Sum, ensuring the city can have more predictable costs for this project.
PSSA #5 will wrap up the re-design. Utility relocation, including the relocation of a major city water line, is expected to start in early 2026 and roadway construction to start in the summer of 2026.
The improvements will enhance regional connectivity and support the Mobility Infrastructure and Connectivity Pillar of the City’s Strategic Plan by improving roadway safety, resiliency, and traffic flow.
With the approval of this PSSA, the total spent on design for Kelly Lane Phase 3 will be $3,298,361.94. The FY26 CIP construction budget for this project is $20,240,000.00
Prior City Council Action
The initial professional services agreement was approved by City Council on July 27, 2021 for an amount of $1,527,103.59 for ESP Associates, Inc (formerly Vickrey Associates) to complete design, bid, and construction phase services.
On July 12, 2022, City Council approved a professional services supplemental agreement #1 for the amount of $376,532.93 for ESP Associates, Inc. to provide PS&E design services to incorporate a right turn lane for the Crosslife Church site and to perform a feasibility study for an approximate 3.8-mile segment of Cele Road from Weiss Lane to FM 973. The feasibility study included development of three (3) alignment alternatives and typical sections utilizing available desktop information to perform a preliminary hydraulic & hydrologic analysis, topographic survey, subsurface utility engineering (SUE), preliminary environmental constraints map and preliminary geotechnical analysis. The Cele Road feasibility study was completed and will be the basis for a future CIP project.
Staff processed a professional services supplemental agreement #2 to reallocate funds to different tasks with no change in the total amount.
On December 10, 2024, City Council approved a professional services supplemental agreement #3 for the amount of $1,210,189 for ESP Associates, Inc. for the roundabout design for the Kelly Lane Phase 3 roadway improvements project (CIP# TR2001)
