A Resolution of the City Council of the City of Pflugerville, Texas, declaring the public purpose and necessity to acquire an approximate 0.0011-acre exclusive permanent utility easement and an approximate 0.2337-acre temporary construction easement; each of which are located in the William Caldwell Survey No. 66, Abstract 162, and being a portion of lot 3f-1 of the replat of replat of lot 3f-Renewable Energy Park, a subdivision within the City of Pflugerville, Travis County, Texas; with an address of 15508 Impact Way; the acquisitions being required to support the City’s construction of the expansion of its 1849 Reclaimed Waterline Project; and authorizing the City Attorney to proceed with activities necessary to acquire said properties, including institution of condemnation proceedings to acquire the necessary land rights through the use of the City’s eminent domain authority
Summary
This resolution has been included on the agenda to follow for discussion and potential action regarding a utility easement and temporary construction easement (Parcel 3) needed for the Reclaimed Waterline to 1849 Park Project. The City has determined a public need to acquire the utility easement and temporary construction easement for the purpose of converting some existing large-volume of portable water users to reclaimed water and reducing the City’s overall potable water usage. The project will also convert the 1849 Park from using potable water for irrigation to reclaimed water.
Unfortunately, the property owner has not been responsive to the City’s land acquisition consultant, 7 Arrows Land Staff LLC, in the attempts to discuss the cost and/terms outlined in the utility easement and temporary construction easement proposals for the Reclaimed Waterline to 1849 Park Project. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process and allow the project to move forward.
Approval of this resolution authorizes the City Manager and the City Attorney, on behalf of the City, to initiate condemnation proceedings and take all actions necessary to acquire the property through the exercise of eminent domain.
Parcel 3- Temporary Construction Easement 0.2337 acres and Utility Easement 0.0011 acres.

Prior City Council Action
City Council approved a professional engineering services with Quiddity in the amount of $148,000 for professional engineering services associated with the preparation of the reclaimed water master plan update for the Reclaimed waterline to 1849 project on September 13, 2022.
City Council approved a professional services supplemental agreement with Quiddity for professional engineering associated with the Reclaimed Waterline to 1849 Park project and authorizing the City Manager to execute the same in the amount of $1,062,043 on November 14, 2023.
City Council approved a work authorization with 7 Arrows Land Staff LLC for right-of-way and appraisal services associated with the 1849 Reclaimed Waterline Project in the amount of $443,800 on June 11, 2024.
City Council approved a professional services supplemental agreement with Quiddity Engineering, LLC for professional engineering services associated with the Reclaimed Waterline to 1849 Park and authorizing the City Manager to execute the same in the amount of $397,696 on July 9, 2024.
