Approving a resolution authorizing an updated Municipal Maintenance Agreement with the Texas Department of Transportation (TxDOT) and authorizing the City Manager to execute the same.
Summary
TxDOT is requesting the City of Pflugerville to review and approve an updated Municipal Management Agreement (MMA). Future multiple use agreements with TxDOT rely on getting this revised agreement approved.
The jurisdictions have not updated the existing MMA since September 2000.
A summary of the purpose and need for the MMA is provided in the attached presentation provided by the TxDOT Austin District. Review of the updated agreement versus the existing agreement revealed few changes but the highlights are provided here:
- establishes that the agreement is between the State and the City only, such that no person or entity may claim third party beneficiary status (General Conditions, 2)
- requires compliance with Americans with Disabilities Act (ADA) (General Conditions, 10)
Separate agreements for Illumination and Traffic Signals are in development and not required at this time.
With reference to the applicability of this agreement, non-controlled access facilities refers to FM 1825 and FM 685, and controlled access facilities refer to SH 45 and SH 130, including frontage roads and adjacent to the main lanes.
Prior City Council Action
The current Municipal Maintenance Agreement date was approved September 26, 2000 as authorized by Resolution 09-26-00-3J.
