Title

Approving an ordinance on second reading with the caption reading: AN ORDINANCE OF THE CITY OF PFLUGERVILLE, TEXAS, GRANTING A PETITION FOR VOLUNTARY ANNEXATION AND ANNEXING, FOR FULL PURPOSES, APPROXIMATELY 7.321 ACRES OF LAND ADJACENT TO THE CITY LIMITS OF THE CITY OF PFLUGERVILLE, TEXAS, GENERALLY LOCATED SOUTH OF PECAN STREET AND WEST OF SH 130, BEING PART OF THE WILLIAM CALDWELL SURVEY NO. 66, ABSTRACT 162 IN TRAVIS COUNTY, TEXAS; EXTENDING THE BOUNDARIES OF THE CITY TO INCLUDE THE LAND; BINDING THE LAND TO ALL OF THE ACTS, ORDINANCES, RESOLUTIONS AND REGULATIONS OF THE CITY; APPROVING A SERVICE PLAN; AND PROVIDING AN EFFECTIVE DATE. Summary

The Pflugerville Community Development Corporation (PCDC) recently purchased 7.3 acres of the Northeast Travis County Park located south of Pecan Street and west of SH 130. The tract includes 1,611 linear feet of the existing Northeast Travis County Park drive, which was purchased to ensure adequate access and future road connectivity to the 160-acre PCDC tract, located between the park and SH 130. The recent acquisition enables PCDC to have unobstructed access and will allow for future road connections between their land and Pecan Street, a constraint under Travis County ownership. The annexation area contains the drive, a 10-ft hike and bike trail and existing natural landscaping. No new improvements are proposed at this time. Upon development of the PCDC tract, it is anticipated the 7.3 acre annexation area will be dedicated to the City of Pflugerville as right of way. The subject area is currently in the Pflugerville CCN for water and in an undefined service area for wastewater. No utilities are required to serve the area at this time. The Police department will be able to patrol the area and provide services as needed. No additional operation or maintenance services are required at this time.

According to Section 43.028 of the Local Government Code, the petition for annexation may be granted since the annexation area is less than one-half mile in width, is contiguous to the City, and is vacant without residents.

Deadline for City Council Action

The petition for annexation was filed with the City on August 19, 2011. According to Section 43.028 of the Local Government Code, City Council shall consider the petition by September 19, 2011. The City Council considered the petition and approved first reading of the ordinance on September 13, 2011.
