Summary
The City of Pflugerville, as a recipient of federal financial assistance, is required to ensure full compliance with the Title VI of the Civil Rights Act of 1964; 49 C.F.R. Part 21 (Department of Transportation Regulations for the Implementation of Title VI of the Civil Rights Act of 1964); 49 C.F.R. Part 21; and related statues and regulations.
Title VI of the Civil Rights Act of 1964 prohibits discrimination based on race, color, or national origin in any program or activity receiving federal financial assistance. Several other federal legal authorities supplement Title VI by extending protections based on age, sex, and disability. In addition, the Civil Rights Restoration Act of 1987 clarified Title VI enforcement by mandating that Title VI requirements apply to all programs and activities of federal-aid recipients regardless of whether any program or activity involves federal funds. Taken together, these laws require recipients and subrecipients of federal funds to ensure all programs and services are delivered to the public without discrimination.
The City uses federal funding for transportation and utility infrastructure improvements. Current transportation projects include Pflugerville Parkway positive offset left turn lanes, safety lighting at Picadilly Drive, dynamic speed feedback signs and accessible pedestrian signals.
The Title VI Program includes a Title VI Plan which outlines how the City incorporates the requirements of Title VI and related legal authorities into its operations. The plan will be updated every three years, as required, and will reflect changes in Title VI compliance operation and serve as an informational resource for the public. Second, the program requires a signed Title VI Nondiscrimination Assurance which confirms that the City will comply with statutory and regulatory authorities and assurances and a Title VI Nondiscrimination Policy Statement. The documents confirm that no person shall on the grounds of race, color or national origin be excluded from participation in, be denied the benefits of, or otherwise be subjected to discrimination under any Department programs or activities.
The City received notice from the Texas Department of Transportation on March 23 that the City had 90 days to adopt a Title VI program. Adopting the Title VI program will bring the City into compliance with the Title VI program to continue to receive federal funding. Representatives from the City Manager’s Office, Capital improvement Project team, Public Works, Finance, Purchasing, Communications and Legal worked on the document to ensure that the City incorporates the Title VI program requirements into our federally-funded projects. The Equity Advisory Board reviewed the plan. Following the adoption of the Title VI Program, the City will submit our Title VI plan to Texas Department of Transportation for final review and publish all materials on our website www.pflugervilletx.gov/titleVI.
