Title
Authorizing the City Manager to execute an Oncor Electric Encroachment Easement Agreement between Oncor Electric Delivery Company LLC and the City of Pflugerville for the necessary water and wastewater easement associated with the Bohls Commercial Park Subdivision (Hawaiian Falls Water Park).
 
Summary
The Bohls Commercial Park subdivision is located along the eastern portion of FM685 and Town Center Drive.  Lot 1 of the Bohls Commercial Park will house the Hawaiian Falls Water Park.  As a requirement of the subdivision preliminary plan application, the development must provide public utilities to each lot within the subdivision and adjacent properties.  A 20-ft City of Pflugerville water and wastewater easement is to be dedicated to accommodate the utility extensions necessary to serve the overall development.
 
Currently there is a 40-ft Oncor Electric easement parallel to FM685 and extends throughout the limits of the proposed subdivision.  To accommodate the required City utility easement while not encumbering too much of the onsite property, the required City easement will overlap the existing Oncor Electric easement by 10 ft.  It is a requirement of Oncor Electric to execute an encroachment easement agreement for any overlapping easements or infrastructure.  By executing this easement agreement, the developer will be able to extend utilities in accordance with the City subdivision requirements and provide the required City easement.
 
The City Attorney and Staff have reviewed and approved the Oncor encroachment easement language.
 
Prior City Council Action
On November 11, 2013, the Council approved ORD-0177 for a special district for an outdoor commercial amusement use at this location.
 
Deadline for City Council Action
Authorization of this item is needed at this time in order to continue the schedule for development of the Hawaiian Falls Water Park.
