Title

Approving a Construction Manager at Risk contract with PLW Waterworks, LLC in the amount of $1,502,344 for the Wilbarger Creek Regional Wastewater Treatment Facility Phase 1 construction Project, and authorizing the City Manager to execute the same.

 

Summary

This agenda item requests approval of a preconstruction phase services contract with PLW Waterworks, LLC. in the amount of $1,502.344.00 for the Wilbarger Creek Regional Wastewater Treatment Facility Phase 1 Construction Project. This item supports the Infrastructure Pillar of the Strategic Plan, by expanding the City’s wastewater treatment capacity to meet current and future growth needs.

 

The 2020 Wastewater Master Plan adopted by City Council in April 2020 included the necessity of constructing a new six (6) million gallons a day (MGD) wastewater treatment plant (WWTP) to serve the Wilbarger basin. This new wastewater treatment facility is expected to meet the Cottonwood and Wilbarger basin’s wastewater treatment needs through 2030.

 

The design was approved in late 2020 and Garver, LLC has completed the design for the project, including: Influent Lift Station, Odor Control, Headworks and Grit Removal, Aeration Basins, Aeration Blower Building, Secondary Clarifiers, RAS/WAS Pump Station, Tertiary Filtration, UV Disinfection, Aeration Sludge Holding Tanks, Chemical Feed Building, Biosolids Handling Building, Operations/Laboratory/Maintenance Building, Plant Wide Power Distribution, Controls and Security Systems along with the decommissioning of Weiss Lane Lift Station.

 

The best value alternative project delivery method for the project was determined to be Construction Manager at Risk.  This method allows the city to proceed with construction, identify if any contractor generated cost optimization options will be implemented and phase the construction in such a way that the City’s financing strategy can be implemented.  A number of Pre-procurement of contracts will be assigned to the contractor for installation and construction. 

 

The project was bid pursuant to Section 2269.251 of the Texas Government Code using the Construction Manager at Risk delivery method, based upon predefined criteria as a best value to the City. The selection criteria for the Construction Manager at Risk included: Experience and Capabilities, Organization, Management, Safety Record, Quality Assurance, Project Approach, Ability to Meet Schedule, Self-Perform Construction Capabilities, Fee and Rate Proposal, and Interview.

 

City staff performed a contractor outreach effort in advance of the bid phase to seek input from interested contractors.  The Construction Manager at Risk request for proposals (RFP) was advertised on January 18, 2023. A Pre-Proposal conference was held on February 1, 2023. On March 2, 2023 at 2:00 p.m., City staff received one proposal for the Project and the results were read out loud for the record.

 

A Selection Committee reviewed and scored the proposal based on the published criteria which included a check of the offeror’s references. The proposer was interviewed and cost optimizations identified, and negotiations were undertaken.  The proposal for preconstruction phase services is $1,502,344.00. The Construction Phase Services fee, with all work based on the Engineers Opinion of Probable Construction Cost of $207 Million, was set at nine percent (9%).  This contract will initiate the preconstruction phase, which will be followed by the phases of construction which will be brought forward for Council approval in the future. 

 

The Engineer of Record, Garver, LLC, recommends PLW Waterworks, LLC, the award of the preconstruction phase services contract for the Wilbarger Creek Regional Wastewater Treatment Facility. City staff concurs with this recommendation. The expected duration of construction is 36 months. The plant is expected to be able to start treating wastewater in March 2026.

 

Prior City Council Action

On September 22, 2020, Council approved selection of Garver for professional services associated with the Wilbarger Creek Regional Wastewater Treatment Facility Project.

 

On October 27, 2020, Council approved a professional services agreement in the amount of $1,650,192 with Garver for the conceptual design of the Wilbarger Creek Regional Wastewater Treatment Facility Project.

 

On June 22, 2021, Council approved a professional services supplemental agreement with Garver in the amount of $7,896,181 for preliminary design, final design and bid phase services for the Wilbarger Creek Regional Wastewater Treatment Facility Project.

 

On July 12th, 2022, Council approved a resolution authorizing the use of the Competitive Sealed Proposal (CSP) procurement method for the Wilbarger Creek Regional Wastewater Treatment Facility (WCRWWTF) Project, including the Pre-Selection of vendors for major treatment process equipment.

 

On September 27th, 2022, City Council awarded a pre-procurement contract to Trojan Technologies for the supply of UV Disinfection Equipment for the WCRWWTF in the amount of $655,520.

 

On January 10th, 2022, City Council awarded a pre-procurement contract to T. Morales Company Electrical and Controls, Ltd. to supply Electrical Equipment for the WCRWWTF in the amount of $7,106,645.

 

On March 14, 2023, City Council awarded a pre-procurement contract to Alterman, Inc. to supply stand-by power Generator set for the WCRWWTF in the amount of $1,667,229.
