Title
Discuss and consider action to reject all bids or award the construction contract for the Immanuel Road Skate Spot project to Misiano Construction & Remodeling Inc., the lowest responsive bidder of 2 bids received on December 30, 2013, in the amount of $72,800 and authorizing the City Manager to execute the contract agreement and authorizing the City Engineer to execute the Notice of Award and Notice to Proceed.
 
Summary
The Immanuel Road Skate Spot project is intended to provide a designated skate spot amenity location for residents immediately adjacent to the City of Pflugerville recreation center.  Included in this project scope are the construction of a half taco and bowl combination, gentle ramps, skate rail, grind edge, stairs and mogul.
 
City staff recommends the award of the construction contract for this project despite some opposition from at least one resident and a majority of the Parks and Recreation Commission for the following reasons:
·      The Immanuel Rd. site was one of two sites selected by the Parks & Recreation Commission.
·      The Immanuel Rd. site is suitable for this development.
·      Close proximity to necessary infrastructure and Parks staff.  The adjacent Recreation Center and Bohls Park both have parking and restroom facilities.  Parks staff at the Recreation Center can keep an eye on the facility.
·      Cambridge Heights Homeowners Association  (HOA) already has concerns with unauthorized usage of the parking lot at their amenity center which is adjacent to the Cambridge Heights Park and concerns with parking along the roadways which border the park.
·      The budget did not support two locations and will not support the re-design necessary to move the project to Cambridge Heights.
The objections to the site were the following:
·      Close proximity to the large skate/bike facility at NE Metro Park.
·      Skate Spot would preclude expansion of the Recreation Center.
·      Want the facility to go on the "underserved" west side of town.
 
If the contract is awarded, construction is expected to begin late January 2014 with completion projected for April 2014.  The attached tabulation of bids includes the base bid and bid alternate values in which the lowest responsive bidder was Misiano Construction & Remodeling Inc.
 
If all bids are rejected, staff will need direction on whether or not to seek additional funding for re-design, select another location, or cancel the project.
 
Site Selection History
•      After the project bounced around a few locations, two (2) sites were approved by the Parks Commission on August 16, 2012 - Cambridge Heights & Bohl's Park.
•      DavCar Engineers (w/ Grindline as sub) were selected as design team.  Design contract executed on Sept 12, 2012.
•      DavCar reviews two approved locations.  Recommends Bohls Park as site.
•      Even with recommendation, DavCar is instructed to design for both locations.  Drawings come back as "watered-down" project with neither "Spot" on track to be successful projects.
•      Decision was made to consolidate into one "Spot" in order to deliver one quality project.  Bohls selected based on DavCar recommendation, proximity to parking, restrooms and parks staff.
•      Supplemental Agreement approved to cover re-design and lengthy delays in project August 5, 2013.
•      Plans delivered to City.
•      Plans submitted for Site Development Permit.  Permit Issued.
•      Decision to proceed with project as approved, designed and permitted was made December 9, 2013.
•      Project put out for bids December 10, 2013.
•      Staff received objections to the site from one resident and one Parks & Recreation Commission member.  Item added to the December 19, 2013 Parks & Recreation Commission meeting agenda to discuss project and select site.
•      Staff gave project update to the Parks & Recreation Commission on December 19th with an action item requesting a recommendation on the skate spot site.
•      Parks & Recreation Commission voted 4-2 selecting Cambridge Heights as the project site.
 
Status
The project was advertised for bids on December 9, 2013.  Two bids were received and opened on December 30, 2013.

Fiscal Impact
The project funding of $100,000 is from the Pflugerville Community Development Corporation.
Staff Recommendation
The Engineering Department recommends awarding contract for the Immanuel Road Skate Spot project to the lowest responsive bidder, Misiano Construction & Remodeling Inc., in the amount of $72,800.
