Approval of a resolution extending the timeframe for consideration of the Timmerman 2020 rezoning case.
Summary
A rezoning request has been filed for approximately 150 acres, located on the north side of East Pecan Street, just east of the Bohls neighborhood. The request is to rezone the property from Agriculture/Development Reserve (A) district to Urban Corridor Level 4 (CL-4) district. The Planning and Zoning Commission considered this item on March 2, 2020.
After the Planning and Zoning Commission’s recommendation is received, the City Council shall conduct a public hearing in accordance with state law. According to Section 3.7.3 E of the Unified Development Code, the public hearing shall be conducted within 60 days following the date of the Planning and Zoning Commission’s recommendation. If a public hearing is not held before City Council within the prescribed 60 days, City Council may extend the 60-day period for a maximum of 30 days by resolution of the Council (no more than two, 30-day extensions may be granted). If the extension is not granted, then the rezoning request will be considered withdrawn and a new application will be required.
Due to the current circumstances with COVID-19, the applicant is requesting that this item be heard on May 12, 2020 which exceeds 60 days from the date the Planning and Zoning Commission held a public hearing on the request. The resolution extends the 60 days, allows for continuance of the request, and allows for consideration of a public hearing on May 12, 2020.
Deadline for City Council Action
Due to requirements of the Unified Development Code (UDC), action is requested on April 28, 2020. If the extension is not granted, the application will be considered withdrawn and a new application will be required.
