Discuss and consider action to allow a Planned Unit Development (PUD) rezoning application to be submitted for 1010 Immanuel Rd, consisting of 10.002 acres in accordance with Section 4.5.3 (B)(A) of the Unified Development Code.
Summary
Section 4.5.3 (B)(A) of the Unified Development Code restricts Planned Unit Development (PUD) applications to properties with 20 acres or more for purposes of establishing unique master planned developments with site specific regulations. The acreage limitation was reduced from 50 acres to 20 acres with prior code amendments in an effort to allow for increased flexibility with the PUD zoning district without becoming overly used. For unique projects that are unable to meet the acreage requirement, Section 4.5.3 (B)(A) allows the City Council to consent to a PUD application being submitted for review.
The property at 1010 Immanuel consists of 10.002 acres and is currently zoned Multi-Family 10 (MF-10) district. The current zoning allows for a variety of residential land uses on the property, including a traditional apartment complex with a density of 10 units per acre. The new owner would like to establish a new "missing middle" housing project with residential structures consisting of townhome, duplex, and quadplex with a different style of housing unit known as a "flat". The applicant would like to propose an increase in density to achieve the variety of housing styles and unit mix needed for the project and has discussed a rezoning of the property to the Multi-Family 20 (MF-20) zoning district which would allow for the housing styles and density, but also entitle the property with an option for a traditional apartment project. If allowed to pursue the PUD zoning application, certainty on the style of residential development including product types, density, design and building orientation, height, building and buffer setbacks, landscaping, fencing, open space, parking, and similar design elements can be included.
The request is therefore to allow for a PUD application to be submitted for consideration at 1010 Immanuel Rd. After discussing the project with the applicant, a rezoning to a Planned Unit Development (PUD) will allow greater certainty of the proposed project without allowing for a traditional apartment project which could be achieved under the current zoning or an alternative zoning district for higher density. Staff recommends approving the request to allow the PUD application to be submitted for 1010 Immanuel.

Prior City Council Action
In 2000, the City Council approved Ordinance No. 585-00-06-13 and 586-00-06013 rezoning the property to Two-Family Residential (RT1) district.
In 2004, the City Council approved Ordinance No. 758-04-09-28 rezoning the property from Two-Family Residential (RT1) district to Multi-Family 10 (MF-10) district.
