Approving an acquisition and improvement agreement with Lakeside Meadows LLC. associated with the Secondary Colorado River Raw Water Line and Weiss Pecan Water Line projects, and authorizing the City Manager to execute the same.

 

Summary

City staff have been working with the developer for the Lakeside Meadows development on 3 easements for both the Secondary Colorado River Raw Water Line and the Weiss Pecan Water Line projects in order to continue the process to keep moving both projects forward. 

 

For the Secondary Colorado River Raw Water Line project, the easements needed will eventually be conveyed to the City as public parkland, but the timing of this conveyance is not advantageous to the City in order to meet our deadline to deliver additional raw water to Lake Pflugerville before summer 2026.  For the Weiss Pecan Water Line project, the City is currently working to finalize this acquisition with Lakeside Meadows, but it requires a portion of the Colorado Sand Roadway near Weiss Lane to be acquired so that the City can use a portion of the future Right of Way for a Temporary Construction Easement.  With the existing Temporary Construction Easements for the Weiss Pecan Water Line project soon expiring, the City cannot delay acquiring this final easement to bid the water line project and minimize the costs the City could incur for the extension of the Temporary Construction Easements. 

 

After a lengthy discussion about these easements with the developer, it was determined that the developer has not had much success with acquiring the easement for the extension of Colorado Sand to Weiss Lane which could cause the City to incur additional costs to extend the time of the Temporary Construction Easements.  After discussion with the property owner as well as the developer, the property owner is more open to working with the City on the property acquisition than the developer.  This agreement aims to satisfy both the needs of the City and the developer by having the City go through the process of acquiring the property for the roadway (with all costs for the acquisition of the roadway property paid for by the developer) in exchange for all of the easements required for our two critical water line projects to be conveyed upon execution of this agreement and acquisition of the property needed for the extension of Colorado Sand.  The developer would still be required to construct the roadway as part of their development agreement which would eventually be a public roadway conveyed to the City after final acceptance by the City.  This agreement has been reviewed and approved by the City's legal team that deals with real estate and land acquisition to ensure it meets the City's goals to keep our CIP projects moving forward efficiently.

 

As this project aims to keep two critical water line projects for the City on schedule, this agreement would meet the City's Strategic Goal of Infrastructure as it allows for the City to prepare City infrastructure for the City's future and current growth and also implements the City's plan to provide resilient and robust water infrastructure to serve current and future residents.
