Discuss and consider action to approve a resolution of the City Council of the City of Pflugerville, Texas, directing the City Manager or the City Manager’s designee to execute all documents to institute eminent domain proceedings for the acquisition of land situated for temporary construction easement and wastewater easement in Pflugerville, Travis County, Texas and directing the City Attorney to initiate condemnation proceedings associated with the 18-Inch Gilleland Creek Wastewater Interceptor Project.

 

Summary

This resolution has been included on the agenda to follow for discussion and potential action regarding temporary construction and a wastewater easement on Parcel 2 needed for the 18-Inch Gilleland Creek Wastewater Interceptor Project. This interceptor is aimed to increase the size of the existing wastewater line that is undersized given the area it serves.  As it currently stands and with existing developments happening in the area, the line could be susceptible to Sanitary Sewer Overflows (SSOs) if it is allowed to remain the same size and have the same capacity. This would be exacerbated by the location as it currently is mostly within floodplain and near low-lying areas where an SSO could result in immense environmental degradation to Gilleland Creek that is already an impaired watershed.

 

As part of the project, it is necessary for the City to acquire a temporary construction easement and wastewater easement to allow for project construction. The property owner has not agreed to the cost and/or the terms outlined in the City's easement proposals regardless of multiple attempts from City Staff, and the City’s land acquisition consultant, Seven Arrows Land Staff LLC. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process and allow the project to move forward. 

 

The project's total budget is $4,504,865. Of this amount, $266,092 is designated for right-of-way acquisition which is funded by utility impact fees. Approval of this resolution authorizes the City Manager and the City Attorney, on behalf of the City, to initiate condemnation proceedings and such other actions are necessary to acquire the property by the exercise of the power of eminent domain proceedings.

This project supports the Residential and Node Development pillar of the Strategic Plan, as well as the adopted Wastewater Master Plan.

Prior City Council Action
City Council Approved a professional service agreement with K Friese & Associates, LLC in the amount of $542,787.27 for design and bid phase services associated with the 18-Inch Gilleland Wastewater Interceptor Project on July 9, 2024.
