Title

Authorizing the City Manager to execute a contract with Lee Lewis Construction in the amount of $4,038,740.00 for the expansion and renovation of the Pflugerville Community Library.

 

Summary

The Pflugerville Community Library Renovation and Expansion Project is a result of a bond referendum approved in May 2008 for $7 million. The project was designed by the architecture firm Vitetta as the prime and Piwonka Sturrock Architects as a subcontractor. Mr. Scott Swiderski, P.E. of HR Gray will continue to represent the City of Pflugerville throughout the construction and close out process.

 

In accordance with the requirements of this procurement process, on September 6th the City received, publicly opened, and read aloud the names of the offerers and, if any are required to be stated, all prices stated in each proposal.  Not later than the 45th day after the date of opening the proposals, the governmental entity shall evaluate and rank each proposal submitted in relation to the published selection criteria.

 

The competitive sealed proposals were solicited with six alternates, described in the attached. Each bid proposal submitted pricing for the alternates but only the base bid, without the alternates, was considered in the scoring of the proposals.

 

Per Sec. 271.116 of the Local Government Code, the governmental entity shall select the offeror that offers the best value for the governmental entity based on the published selection criteria and on its ranking evaluation. The governmental entity shall first attempt to negotiate a contract with the selected offeror. The governmental entity and its engineer or architect may discuss with the selected offeror options for a scope or time modification and any price change associated with the modification. If the governmental entity is unable to negotiate a contract with the selected offeror, the governmental entity shall, formally and in writing, end negotiations with that offeror and proceed to the next offeror in the order of the selection ranking until a contract is reached or all proposals are rejected. In determining best value for the governmental entity, the governmental entity is not restricted to considering price alone, but may consider any other factor stated in the selection criteria.

 

Status

The staff has negotiated the construction contract and recommended a final contractor awardee and final price to the City Council for approval. As required, the city has documented the basis of its selection and shall make the evaluations public not later than the seventh day after the date the contract is awarded. Construction is anticipated to last 485 calendar days, or about 16 months. The selected contractor will develop a final project schedule that will accompany the contract.

 

Prior City Council Action

The City Council acted on May 24, 2011 to authorize the competitive sealed proposal process as required by statute. On October 11, the Council authorized the City Manager to negotiate with Lee Lewis Construction.

 

Deadline for City Council Action

Staff requests authorization on this date in order to maintain the project schedule.

 

Fiscal Impact

This project is being funded with General Obligation bonds. A project appropriation summary is attached.

 

Staff Recommendation

Staff recommends approval of this item authorizing the City Manager to execute a contract with Lee Lewis Construction with all six project alternatives for a total of $4,038,740.00.
