Summary
The New Sweden development agreement was created in March 2007 and established the ability to create three Municipal Utility Districts (MUDs) for purposes of establishing new residential subdivisions along the FM 973 corridor. Each of the districts specified how utilities were to be provided, the number of residential units per district, and the development standards that would be applicable. As development pressure has increased along the FM 973 corridor, the three developments are preparing to move forward with development. A modification was recently made to clarify how wastewater service will be provided, which included an adjustment to have wholesale wastewater service provided by Pflugerville through a regional lift station vs. a new wastewater plant. That agreement was approved in June 2024.
With the approved amendment to the wastewater agreement, the development agreement for the New Sweden Municipal Utility District No. 3 Development Agreement also needs to be amended to reflect the wastewater agreement and to provide further clarification on the development standards. Below are the more substantial modifications to the agreement:
Roadway: A realignment of Britta Olson, a county road, is proposed to remove an existing "S" curve through the development to increase safety. The original agreement included design and construction standards from 2005. The proposed amendment updates the requirements and states road infrastructure internal to the development will be consistent with City requirements, including requiring a minimum 4' wide sidewalk along the residential streets.The development will remain subject to Travis County requirements for a TIA and boundary street right of way dedication and improvements as may be applicable.
Lots: To offset the cost of the realignment, the lot count is proposed to increase from the original 809 single family lots, to 888 single family lots. The original agreement allowed a lot size of 40'x110' with a maximum of 29% of the lots having the 40' width; no changes are proposed to the minimum size or limited percentage of the smaller lots. The original agreement identified not less than 16.7% of the lots to be 60' in width. The proposed amendment reduces the lot width to 50' to enable additional number of lots to account for the increase in cost related to the realignment of Britta Olson Road.
Development Standards: Block length, parking, and impervious cover was not included in the original agreement and is now included. Residential building materials will be consistent with the original agreement and have 100% cementitious material on the front and both sides, and 75% cementitious on the first floor.
Building Permits: The original agreement did not require building permits. The proposed amendment requires permits and inspections from the City for framing, electric, and plumbing to enhance public safety. The agreement also clarifies that the respective trades will pay City fees and will follow the codes adopted by the City.
The proposed amendment provides clarification to the development of the property and increases health and safety considerations.
