A Resolution of the City Council of the City of Pflugerville, Texas, declaring the public purpose and necessity to acquire an approximate 1.157-acre waterline easement and an approximate 1.196-acre temporary construction easement; each located in the William Caldwell Survey, Abstract 162, and such property addressed as 1642 Cameron Rd; said waterline and temporary construction easements being further described by metes and bounds; the acquisitions being required to support the City’s construction of the expansion of a 12-inch looping water improvements in the City’s 749 Pressure Zone Project; and authorizing the City Attorney to proceed with activities necessary to acquire said properties, including institution of condemnation proceedings to acquire the necessary land rights through the use of the City’s eminent domain authority
Summary
This resolution has been included on the agenda to follow for discussion and potential action regarding the waterline easement and temporary construction easement (Parcel 3) needed for the 12-Inch Looping Improvements in 749’ Pressure Zone Project. The City has determined the public need to acquire the waterline easement and temporary construction easements as part of the 2024-2028 Capital Improvement Program for water. This project will provide a new 12-Inch waterline along Weiss Lane, Pecan Street, and Cameron Road. This waterline will serve growth in the southern part of the Central Pressure Zone.
Unfortunately, the property owner has not been agreeable to the cost and/or the terms outlined in the waterline easement and temporary construction easement proposals. Staff and the City’s land acquisition consultant, 7 Arrows Land Staff LLC, have conducted discussions with the property owners regarding the waterline easement and temporary construction easement terms. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process and allow the project to move forward.
Approval of this resolution authorizes the City Manager and City Attorney, on behalf of the City, to initiate condemnation proceeding and take all actions necessary to acquire the property through the exercise of eminent domain.

Prior City Council Action
City Council approved a professional services agreement with Binkley and Barfield, Inc in the amount of $652,166 to provide engineering services associated with the 12-Inch Looping Improvements in Central Pressure Zone and authorizing the City Manager to execute the same on June 25, 2024.
City Council approved a Work Authorization with 7 Arrows Land Staff, LLC., in the amount of $164,000 for professional services associated with the 12-Inch Looping Improvements in 749’ Pressure Zone project and authorizing the City Manager to execute the same on September 24, 2024.
