Title

Approving a resolution appointing a Capital Improvement Advisory Committee regarding water and wastewater impact fees.

Summary

The City of Pflugerville is currently working with Lockwood, Andrews, and Newnam, Inc. (LAN) to revise the current impact fees based on updates to land use assumptions and the capital improvements plan (CIP) as required by Chapter 395 of the Texas Local Government Code to be done at least every five years. The initial five-year period begins on the day the capital improvements plan is adopted. The current impact fees were adopted by ordinance on June 26, 2007. Chapter 395.058 of the Texas Local Government Code establishes the requirements for  the appointment of a Capital Improvement Advisory Committee to advise and assist the City Council in matters related to the adoption or revision of impact fees. The Planning and Zoning Commission may act as the advisory committee if the commission includes at least one representative of the real estate development or  building industry.  Mr. Tom Anker, a member of the Planning and Zoning Commission, is employed in real estate development, thus fullfilling that requirements. However, since the study area consists of water and wastewater service areas in Pflugerville's extraterritorial jurisdiction (ETJ) that are subject to impact fees, the membership must include a representative of the real estate development or building industry from the ETJ. Mr. Chris Fields of Buffington Capital is currently the developer of the Villages of Hidden Lakes in our ETJ and has agreed to serve on the committee.

 

Status

LAN is currently under contract to prepare a Water and Wastewater Impact Fee Study.

 

Prior City Council Action

City Council approved an agreement for additional services with LAN for the preparation of a Water and Wastewater Impact Fee Study on January 24, 2012.

 

Deadline for City Council Action

Staff is requesting approval on March 27, 2012 to maintain the proposed schedule.

Projected Future City Council Action

During the impact fee update process, actions will be requested from the City Council in April, May, and June 2012 to schedule a public hearing and to adopt land use assumptions, CIP, and receive impact fee updates from staff.

 

Fiscal Impact

The cost of the impact fee study is approximately $82,000.
