Title

Approving an ordinance on second reading with the caption reading: An Ordinance of the City of Pflugerville Readopting Code of Ordinances Title IX General Regulations, Chapter 95 Parks and Recreation Subchapter 95.50 Youth Programs Standards of Care; Replacing all ordinances in conflict; containing a savings clause and declaring an effective date.

 

Summary

The Texas Human Resources Code Section 42.041 (b) (14) provides an exemption to child care licensure requirements for an elementary-age recreation program operated by a municipality provided that the governing body of the municipality annually adopts standards of care by ordinance after a public hearing for the program. This ordinance has been provided to establish these standards of care in order to exempt Pflugerville Parks and Recreation programs from state child care licensing requirements. These standards of care are intended to be minimum standards by which the City will operate its Parks and Recreation Department summer camp and other programs. Pflugerville Parks and Recreation programs are recreational in nature and are not child care programs.

 

One change was made to the current ordinance approved by CIty Council April 23, 2024. The added weather safety guidelines under Program Operations to establish policies for hot and cold weather conditions, aligns with the standards of the University Interscholastic League (UIL), Pflugerville Independent School District (PfISD), and the National Oceanic and Atmospheric Administration (NOAA). These guidelines ensure the health and safety of participants by providing clear protocols for extreme temperatures.

 

Passing this ordinance directly supports the Pflugerville Strategic Plan by reinforcing the City’s commitment to public safety, service excellence, and community engagement. The new weather and water safety protocols protect youth participants, contributing to Pflugerville’s goal of becoming the safest city in Texas. By maintaining high-quality and structured recreation programs, the ordinance enhances the community’s access to safe and engaging services while ensuring efficient resource management. Keeping the City’s youth programs exempt from state child care licensing allows for greater flexibility in operations while upholding rigorous safety and service standards. Additionally, strengthening program oversight and implementing best practices in risk management fosters community confidence, increasing participation and reinforcing Pflugerville’s reputation as a city that prioritizes the well-being of its residents. These efforts align with the City's strategic priorities of maintaining a high quality of life, ensuring fiscal sustainability, and providing robust, resilient infrastructure.

 

A public hearing and re-approval of the ordinance is required each year.
