Approving an ordinance on second reading with the caption reading: An ordinance of the City of Pflugerville, Texas amending Ordinance No. 1203-15-02-24 of the City of Pflugerville, Texas, as amended, by rezoning an approximate 2.509-acres of land, being all of Lots 1A and 1B, Block A, Replat of Lot 1, Pflugerville Industrial Park, A Subdivision recorded in Document Number 202500014, Official Public Records, Travis County, Texas generally located at 18801 Weiss Lane from General Business 2 (GB2) to General Business 1 (GB1); to be known as the Weiss Retail Center Rezoning (REZ2025-00001); providing for repeal of conflicting ordinances; providing for severability; and providing an effective date.
Summary
The subject tract consists of 2.509 acres of land, being all of Lots 1A and 1B, Block A, Replat of Lot 1, Pflugerville Industrial Park. The subject tract was annexed into the city February 13, 2006 (ORD818-06-02-14). The property was rezoned to General Business 2 (GB2) (10-79-11-06-14).
The subject property currently has a fuel station with general retail store and additional unit structure intended for a variety of retail uses. The applicant is requesting to rezone to General Business 1 (GB1) to allow for the use of personal service, which is currently not permitted in GB2. General Business 1 is also considered a less intense use that GB2, making it more appropriate within the Future Land Use designation of Neighborhood/Retail/Office/Commercial.
Proposed District:
The applicant is requesting to rezone the subject lot to the General Business 1 (GB1) zoning district.
GENERAL BUSINESS 1 (GB1): The General Business 1 (GB1) district is designed to accommodate a full range of retail and office uses with a city-wide and even regional trade area. These types of commercial uses are conducted wholly within an enclosed building. The uses in this district have operating characteristics and traffic service requirements compatible with typical office, retail, shopping, and high-density residential environments.
Comprehensive Plan:
The Future Land Use Map (FLUM) from the Aspire Pflugerville 2040 Comprehensive Plan, adopted in 2022, identifies the area as Neighborhood Retail/Office/Commercial. The comprehensive plan describes the proposed future land use for the subject tract as follows:
NEIGHBORHOOD RETAIL/OFFICE/COMMERCIAL: The Neighborhood Retail/Office/ Commercial future land use category applies to retail sites at the intersections of major arterial roadways that have traditionally served the convenience retail, service, office, and institutional needs of surrounding neighborhoods. Neighborhood Retail establishments include a variety of retail and personal service businesses that meet the daily needs of the residents. This development type generally includes small-or medium- scale development ranging from 1,500 square feet to 45,000 square feet and one to two stories in height.
Staff Recommendation
The proposed zoning district of General Business 1 (GB1) is consistent with the 2040 Aspire Pflugerville Comprehensive Plan and meets the goal of promoting development formats that are more efficient with infrastructure and also help preserve the character of the area. If rezoned, this will allow for more unified development for the placing General Business 1 (GB1) zoning on either side of the Light Industrial (LI) zoning along Weiss Lane.
For these reasons, staff recommends approval of the request to rezone the subject tract from General Business 2 (GB2) to General Business 1 (GB1).
City Attorney has approved the ordinance as to form.
Planning and Zoning Commission Action
On April 7, 2025 the Planning and Zoning Commission conducted a public hearing and recommended approval of the proposed ordinance with a vote of 6-0.
