Summary

This resolution has been included on the agenda to follow for discussion and potential action regarding waterline easements and temporary construction easements (Parcels 2, 2.1 & 3) needed for the 30-Inch SH 130 and Pfluger Farm Lane Waterline Project. The City has determined a public need to acquire waterline easements and temporary construction easements for the purpose of a 30-inch waterline along the west side of State Highway 130 north of Pflugerville Parkway to FM 685. This includes a 30-inch waterline along Town Center Drive and crossing State Highway 45, providing a means to fill the ground storage tank from the central pressure zone.  

 

Unfortunately, property owners have not been agreeable to the cost and/or the terms outlined in the waterline easements and temporary construction easements proposal. Staff and the City’s land acquisition consultant, 7 Arrows Land Staff LLC, have conducted discussions with the property owners regarding the waterline easements and temporary construction easements terms. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process and allow the project to move forward. 

 

Approval of this resolution authorizes the City Manager and the City Attorney, on behalf of the City, to initiate condemnation proceedings and take all actions necessary to acquire the property through the exercise of eminent domain.

Parcel 2.1- Waterline Easement 0.3870 acres and Temporary Construction Easement 0.9090 acres

 

Parcel 3- Waterline Easement 1.0290 acres and Temporary Construction Easement 1.670 acres

 

Prior City Council Action

City Council approved the selection of Walker Partners, LLC for professional services associated with SH-130 waterline project and authorized the City Manager to execute a professional services agreement in the amount of $648,788 on August 9, 2022.

 

City Council approved a work authorization with Seven Arrows Land Staff, LLC in the amount of $278,800 for right-of-way and appraisal services with the SH 130 Waterline Project on August 27, 2024.

 

City Council approved a professional services supplemental agreement with Walker Partners, LLC in the amount of $957,358 for professional services associated with the SH 130 Waterline project on November 12, 2024.

Recommended Action

Approve a resolution authorizing the City Manager or the City Manager’s designee to execute all documents to institute eminent domain proceedings for the acquisition of land situated for the waterline easements and temporary construction easements in Pflugerville, Travis County, Texas and directing the City Attorney to initiate condemnation proceedings.
