Executive Session Item: Consultation with legal counsel regarding the petition for the creation of the proposed Travis County Emergency Services District (ESD) #2A following Travis County Commissioners Court's consideration of the petition and the further options for integration of Fire and First Responder services within the City pursuant to Chapter 551.071 of the Texas Government Code.
Summary
A petition was filed with the Travis County Commissoners Court in December seeking an election on whether to create Travis County ESD #2A, an emergency medical services overlay district, pursuant to Texas Health & Safety Code Chapter 775. The original boundaries of the proposed ESD #2A were identical to the current boundaries of Travis County ESD #2. The city did not consent to that territory within its city limits, which modified the boundaries of the proposed district to exclude the territory within the city limits but include the area within the city's extra-territorial jurisdiction. Questions related to the legal options available to the city to provide fire and emergency medical services in the future will be discussed.
This agenda topic was discussed at the regular City Council meeting on January 8, 2013 and action on the item was tabled until the regular meeting on January 22, 2013. This item was discussed at the January 22, 2013 worksession and January 22, 2013 regular meeting and action on the item was tabled until the special meeting on February 5, 2013. The City Council took action on the petition at the special meeting on February 5, 2013 to not consent to the inclusion of the territory within the city limits of the City of Pflugerville in a proposed election for the creation of an ESD #2A; to consent to the inclusion of the territory within the ETJ of the City of Pflugerville in a proposed election for the creation of an ESD #2A; and to direct city staff to investigate and report to Council exploratory options for integrating and providing first responder services and other emergency services within the City of Pflugerville. The Travis County Commissioners Court held a public hearing on the petition on February 12, 2013 and no action was taken. The Travis County Commissioners Court held an additional public hearing and considered action on the petition on March 1, 2013. The Travis County Commissioners Court found that they could not take action on the petition and therefore, an election was not called.
This item has been scheduled on the March 26, 2013 agendas for the City Attorney to provide additional information to the City Council.
This item has been included on the worksession and regular meeting agendas to allow for discussion on the item. The City Council is expected to retire to executive session on the item pursuant to Chapter 551.071 of the Texas Government Code for consultation with legal counsel. No action will be taken.
