Summary
The Texas Human Resources Code Section 42.041 (b) (14) provides an exemption to child care licensure requirements for an elementary-age recreation program operated by a municipality provided that the governing body of the municipality annually adopts standards of care by ordinance after a public hearing for the program. This ordinance has been provided to establish these standards of care in order to exempt Pflugerville Parks and Recreation programs from state child care licensing requirements. These standards of care are intended to be minimum standards by which the City will operate its Parks and Recreation Department summer camp and other programs. Pflugerville Parks and Recreation programs are recreational in nature and are not child care programs.
The Department has added a section on water safety under Facility Standards to include new legislation passed as a result of Cati's Act in the state legislature during the 88th Legislative Session. These details are provided in the attached Standards of Care Ordinance under § 95.64 Release of Participants. No other changes have been made.
This ordinance was approved as written by the City Council last year. The ordinance has been approved as to form by the City Attorney.
A public hearing and re-approval of the ordinance is required each year.
