Approving a resolution declaring the City of Pflugerville's intent to adopt agreement with Manville Water Supply Corporation.
 
Summary
Following the approval of the resolution approved on March 12, 2013, Mayor Jeff Coleman, Councilmember Wayne Cooper, and City Manager Brandon Wade have met regularly with Manville Water Supply Corporation representatives to include Board President Dave Reichek,  former Board Treasurer James Whitely, Board Secretary Jack Atterstrom, General Manager Tony Graf, as well as Mr. Charlie Schnable.  At the most recent meeting held on August 12, 2013, an agreement was proposed to establish a new wholesale water agreement between the City of Pflugerville and Manville Water Supply Coporation for the sale of water from Manville to the City of Pflugerville.  With the approval of the new wholesale water agreement, the wholesale agreeement between Travis County Municipal Utility District No. 5 and the Manville Water Supply Corporation would be dissolved.  The agreement is currently being drafted by the City Attorney and Manville's attorney.  This resolution is being brought forward for Council's consideration to express the City's intent in adopting this agreement with the Manville Water Supply Corporation.
 
Prior City Council Action
On March 12, 2013, the City Council approved a resolution declaring the City of Pflugerville's intent to establish a cooperative water policy with Manville Water Supply Corporation and directing and authorizing the City Manager to negotiate and collaborate with Manville Water Supply Corporation to create a water policy to be jointly adopted.
 
On April 9, 2013, the City Council approved a resolution authorizing payment in the amount of $250,000 for decertification of the Certificate of Convenience and Necessity (CCN) of the Manville Water Supply Corporation for the Sorento Property and acknowledging the decertification as a gesture of cooperation, conciliation and goodwill by the Manville Water Supply Corporation.
 
On July 23, 2013, the City Manager provided an update to the City Council on negotiations with Manville Water Supply Corporation.
