Approving a resolution setting a May 27, 2014 public hearing date before the Pflugerville City Council to receive public comment regarding revisions to Pflugerville's water and wastewater impact fees.  
 
Summary
The City of Pflugerville utilizes water and wastewater impact fees to insure that new development assumes a portion of the cost of growth and development within the utility system.  The proposed fees are assessed based on the water meter size for new residential and commercial construction, and a door count for new multifamily development.  The revenue is typically collected upon the issuance of a building permit.
 
Chapter 395 of the Texas Local Government Code establishes the framework for the establishment of impact fees. Sec. 395.047 requires the City to update the land use assumptions and capital improvements plan (CIP) at least every five years.  
 
City staff has worked with Lockwood, Andrews, and Newnam, Inc. (LAN) to revise the current impact fees based on updates to land use assumptions and the utility Capital Improvements Plan (CIP) as required by Chapter 395 of the Texas Local Government Code.  
 
As required by Chapter 395 of the Texas Local Government Code, a Water and Wastewater Impact Fee Study considering the capital improvements included in the new water and wastewater master plans, adopted by the City Council on January 28, 2014, has been completed.
 
Staff presented the study's land use assumptions, updated fees and schedule to the Capital Improvements Advisory Committee (CIAC) at its February 3, 2014 meeting, and will meet again with the CIAC in April and May for comments and feedback.  This resolution provides for a 30-day publication notice for a public hearing to be set for the City Council's May 27, 2014 meeting. Staff presented the land use assumptions and CIP for proposed Water and Wastewater Impact Fees in a public hearing before the City Council as required the Texas Local Government Code on March 25, 2014.  
 
Projected Future City Council Action
May 27th       Public Hearing on Impact Fees and First Reading of Impact Fee Ordinance
June 10th       Second Reading of Impact Fee Ordinance
 
Based on this schedule, the effective date for the new fees is proposed to be July 1, 2014.
Fiscal Impact
The City will realize a net positive fiscal impact if the ordinance is adopted.

Staff recommends approval of the resolution setting a May 27, 2014 public hearing date before the Pflugerville City Council to receive public comment regarding revisions to Pflugerville's water and wastewater impact fees.
