Discuss and consider action to approve a resolution of the City Council of the City of Pflugerville, Texas, directing the City Manager or the City Manager’s designee to execute all documents to institute eminent domain proceedings for the acquisition of right-of-way and drainage easement in Pflugerville, Travis County, Texas and directing the City Attorney to initiate condemnation proceedings associated with the East Pflugerville Parkway (Colorado Sand to Weiss Lane) Project.
Summary
This resolution has been included on the agenda to follow for discussion and potential action regarding right-of-way and drainage easement on Parcel 2/2E needed for the East Pflugerville Parkway (Colorado Sand to Weiss Lane) Project. The project will widen the roadway to a four-lane urban section including new traffic signals, lighting, a shared-use path, and improvements to utilities and drainage infrastructure. This project was identified for design in the 2020 General Obligation Bond Program, construction is being funded by the 2025 Certificate of Obligation Bond. Bidding is expected to begin later this month.
As part of the project, it is necessary for the city to acquire this right-of-way and drainage easement for the purpose of constructing this project. The property owner has not agreed to the cost outlined in the easement proposals. Staff, City legal counsel and the City’s land acquisition consultant, Lockwood, Andrews & Newnam, Inc., have conducted discussions with the property owner regarding the right-of-way and drainage easement. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process and allow the project to move forward.
The project's total budget is $22,452,278, of which $2,500,000 is designated for right-of-way acquisition and is funded through the 2022 General Obligation Bond. Approval of this resolution authorizes the City Manager and City Attorney, on behalf of the City, to initiate condemnation proceedings and take all actions necessary to acquire the property through the exercise of eminent domain.
This project supports the Mobility Infrastructure and Connectivity pillar of the Strategic Plan.
Prior City Council Action
City Council approved Professional Services Agreement with LJA Engineering, Inc for professional services associated with East Pflugerville Parkway from Colorado Sand Drive to Weiss Lane Roadway in the amount of $799,886.36 on April 13, 2021.
City Council approved professional services supplemental agreement with LJA Engineering, associated with the 2020 Transportation Bond Program Project in the amount of $81,235.00 on March 8, 2022.
City Council approved a conditional purchase agreement and associated conveyance documents between Michael and Louise Stubblefield (Parcel No.4) and the City of Pflugerville as necessary to acquire real property interest for the E. Pflugerville Parkway (Colorado Sand Drive to Weiss Lane) in the amount of $52,291.00 on
February 13, 2024.
City Council approved a conditional purchase agreement and associated conveyance documents between JY properties, LLC (Parcel No 1) and the City of Pflugerville as necessary to acquire real property interest for the E. Pflugerville Parkway (Colorado Sand to Weiss Lane) project in the amount of $82,980.00 on May 13, 2025.
