Approving a First Amendment to the Penley Park Development Agreement between Penley Park Development Company, Inc. and the City of Pflugerville, Texas and authorizing the City Manager to execute the same.
 
Summary
Penley Park is a residential development located generally northeast of the Heatherwilde Blvd. and SH 45 intersection, east of the Greenridge subdivision, and along the south side of Gattis School Rd. The development agreement was originally approved in 2007 when the property was located within the City's Extraterritorial Jurisdiction (ETJ), and allows for a neighborhood with a variety of housing options. A preliminary plan reflecting the configuration outlined in the development agreement was approved in 2007. Through inactivity, the original plan became expired, however in March 2013, a new preliminary plan with phasing was approved and includes 161 residential lots, of which 111 are "standard lots", 28 are "garden homes", and 22 are "townhome lots". A final plat for Phase 1 was approved in September 2014. Through the review of the final plat, it was identified that the development agreement should be updated to further clarify expectations of the development and design standards within the development.
 
Proposed amendments include: Clarification to the maintenance and ownership of a community road easement as noted on the Phase 1 final plat, and as anticipated with the Phase 2 final plat; update and reference to the Unified Development Code development standards for townhome and garden home products; addition of a minor administrative amendment process; clarification to the text of the agreement to make lot dimensions consistent with the approved preliminary plan and final plat; a proposed reduction in the rear yard building setback for homes on "standard lots" with a first floor footprint greater than 2,500 square feet; opportunities to enter into future license agreements for private landscaping improvements and private maintenance within public parkland lots; and removal of possible elevations of homes no longer being considered within the development.
