Summary
The Fairways of Blackhawk Phase VII subdivision was platted in 1993 while outside of the City of Pflugerville ETJ. In 1995, a Turn Around Easement was established through separate instrument on Lot 68, Block 1, locally known as 19305 Sotogrande Drive. Construction plans identified Sotogrande Drive to be extended further to the north across the floodplain, and the turn around easement was created in the event a cul-de-sac might be needed. Sotogrande Drive was not extended across the floodplain and a permanent cul-de-sac was not ever constructed. Although current requirements would require a cul-de-sac at the end of a permanent dead end street, the subdivision was created outside of the Pflugerville ETJ.
Recently a new single-family home was constructed at 19305 Sotogrande Drive. At time of permit and subsequent construction, the easement was not identified on the survey and a portion of a house was built within the turn around easement. Staff including ESD No.2 have reviewed the request and identified a cul-de-sac in this location is not necessary given the close proximity of the lot to the Sotogrande Drive and Dunes Drive intersection. Public utility easements overlap the turn around easement along the front and sides of the lot, but are not part of the proposed easement vacation. Removing the turn around easement will relieve the unintentional encroachment and intended temporary nature of the easement.
This ordinance was approved on first reading on March 13, 2012.
