Title
Authorizing the City Manager to enter into a Facility Use Agreement for the Kayak/Canoe Rental Concession at Lake Pflugerville.
 
Summary/Status
Tie City of Pflugerville has contracted for the rental of canoes and kayaks since the summer of 2010. The current concessionaire, Mr. Roland Jimenez, provided the City a letter indicating that he no longer wishes to provide the Kayak/Canoe Concession at Lake Pflugerville, and requested that his agreement be assigned to Mr. Randy Martin.  Staff has reviewed the qualifications of Mr. Martin, and we believe he is qualified to operate the concession.
Based on Mr. Jimenez' letter, staff has cancelled the previous concession contract and we are recommending that the City Council authorize the City Manager to enter into a new agreement with Mr. Martin. The agreement is for one season, with the option of two renewals.  The major change that is proposed is to allow Mr. Martin to sell prepackaged beverages and snacks. Mr. George Hyde, City Attorney, has reviewed this contract.
In addition, Mr. Martin has requested amending the days and hours of operation. Proposed changes include closing two days per week on Mondays and Tuesdays, while opening an hour earlier on the weekends during peak season.   Mr. Martin's proposal is shown below as 2012 Proposed Hours of Operation Requirements.  Staff has provided the current schedule, 2011 Hours of Operation Requirements, for comparison.

The Parks and Recreation Commission voted unanimously at the April 19, 2012 meeting to recommend support of the new contract.
 
Deadline for City Council Action
There is no deadline for City Council action.  However, staff would like to begin the rentals as soon as possible.
 
Fiscal Impact
The contract for this activity states that the City will receive 10% of the gross revenues.  Last year, the total received by the City was approximately $1,000.
Staff Recommendation
Staff recommends authorizing the City to enter into a Facility Use Agreement with Mr. Randy Martin.
