Summary
This item is for approval of a Chapter 380 economic development agreement for extension of a public wastewater main in connection with the Springbrook Apartments wastewater improvements project. The City is entering into this agreement as a mechanism to extend public wastewater improvements to further economic growth for properties north of the Springbrook Apartments site. The developer is currently constructing approximately 792 linear feet of public wastewater main for the development of private property. The City initiated discussions with the developer for the additional 800 linear feet of public wastewater extension (see Exhibit A) in order to provide gravity sewer service to properties north of New Meister Lane (see Exhibit B) for the purposes of economic development. The properties identified on Exhibit B do not have access to an adequately sized public sewer line necessary for full development of the area. The necessary infrastructure to service all properties within Exhibit B is currently outside the 10 year timeline of the City's Wastewater Master Plan and therefore is reliant upon private development for more immediate implementation. Without futher extension of the wastewater at this time, full buildout of development will not be able to occur in Exhibit B until such improvements as illustrated on Exhibit A are completed. For all properties northeast of the New Meister/Meister intersection, a subsequent wastewater main will be required adjacent to the Mokan corridor routing all effluent to an existing 24-inch wastewater main at the Heatherwilde Blvd/Wilke Ridge Lane intersection. This 380 economic development agreement provides for the payment from the City to the developer for the cost of the additional 800 linear feet of public wastewater extension. This amount is not to exceed $180,837.67.
Attached to this item is the 380 economic development agreement drafted by staff, approved by the City Attorney, and already executed by the Developer.
