Discuss and consider action regarding a request for Tax Increment Reinvestment Zone (TIRZ) reimbursement for public improvements related to the North Pointe East Development located along SH130, north of East Pflugerville Parkway and south of Copper Mine Drive, in the amount of $4,362,224.

 

Summary

The subject property is approximately 38 acres, generally located north of East Pflugerville Parkway and south of Copper Mine Drive. It is in within proximity to Falcon Pointe residential uses to the east, the existing hospital and new medical offices under construction to the south, and commercial uses and Hendrickson High School to the north.

The property owners and development partners (the “applicant”) are requesting reimbursement for up to $4,362,224 for the costs associated with public infrastructure, including the following:

- On-site and off-site wastewater improvements
- Street improvements (Alba Bonita Drive and Elan Drive)
- Land value associated with the public right-of-way dedication of Alba Bonita Drive and Elan Drive
- TxDOT decel lanes
- Soft costs, including engineering, master developer pursuit costs, management fee on hard costs, bond, city permit and inspection fees, materials testing fees, construction management, and financing costs.

The extension of Colorado Sand Drive, a minor arterial roadway with related detention, is currently being constructed through the tract by the City and is not part of this request.

On December 11, 2024, the TIRZ Board unanimously recommended denial of the TIRZ reimbursement request with a vote of 5 to 0.

Fiscal Impact

$4,362,224 plus City administration and legal costs over the course of the TIRZ reimbursement agreement

 

Staff Recommendation

Staff recommends denial of the proposed TIRZ reimbursement request as it is not consistent with the established TIRZ No. 1 Reimbursement Guidelines. Elements of inconsistency are provided below:

 

- Inconsistency with City’s land use, economic development and incentive goals and policies established in the City Council Strategic Plan and Aspire 2040 Comprehensive Plan

- Lack of regional public infrastructure improvements needed to the support the development

- Development not exceeding minimum development requirements

TIRZ Board Recommendation

On December 11, 2024, the TIRZ Board unanimously recommended denial of the TIRZ reimbursement request with a vote of 5 to 0.
