Approving a professional services supplemental agreement with Freese and Nichols, Inc. in the amount of $135,593 to provide additional construction administration phase services associated with the Central Wastewater Treatment Plant Expansion Phase 1 project, and authorizing the City Manager to execute the same.
Summary
This agenda item is requesting City Council approval to extend the Engineer of Record’s construction administration phase services, provided by Freese and Nichols, Inc., in association with the Central Wastewater Treatment Plant Expansion Phase 1 project. This item supports the Infrastructure pillar of the Strategic Plan.
In March 2017 Freese and Nichols, Inc. (FNI) began work with the initial planning study for the Central Wastewater Treatment Plant (CWWTP) Expansion project. Subsequent Professional Service Agreement Amendments (PSSA) covered design services and construction phase services for Phase I of the Expansion, and design services for Phase II of the Expansion, including adjustments to the scope of work as the design progressed. This PSSA covers additional services related to construction administration phase Services for the Phase I construction due to the extended construction completion date.
Phase I construction began October 19, 2019. FNI’s scope of services for the Construction Phase is authorized by PSSA No. 5 was based on a construction duration of 24 months, with Substantial Completion scheduled for October 12, 2021. Construction contract change orders extended the construction contract to a revised Substantial Completion date of April 2022, an additional 6 months. FNI agreed to provided construction phase engineering services through the revised April 2022 completion date without additional compensation. The most recent construction schedule provided by the contractor revised the Final Completion date to August 2023. The Basic Services included in this PSSA extend FNI’s construction phase services for an additional nine (9) months to cover effort from February 23, 2023 through the projected final completion in August 2023 and covers engineering services through project closeout.
The additional services included in this request add additional time to existing construction phase services regularly occurring monthly activities of FNI and the electrical and instrumentation subconsultant Gupta and Associates, Inc. (GAI)., as described below:
• Project Management/Invoicing
• Bi-Weekly Commissioning/Start-up Coordination work effort
• Monthly Construction Progress Meetings and Site Visits for inspection of completed work and work progress
• Maintenance of Project Management Information System and project as-builts.
The Engineer of Record additional construction administration phase services are extended through November, 2023.
Prior City Council Action
Pflugerville City Council approved Professional Services Agreement with FNI for Pre-Design and Permitting services in the amount of $375,806.00 at the March 28, 2017 meeting.
Pflugerville City Council approved Professional Services Supplemental Agreement No. 1 modifying the scope to add Design and Bid Phase Services and increasing by $3,442,165.00 the amount payable under the Agreement for a total of $3,817,971.00 at the February 27, 2018 meeting.
City and Consultant executed Professional Services Supplemental Agreement No. 2 for Design Phase and Bid Phase Services on October 31, 2018 modifying the scope and increasing by $0 the amount payable for a total of $3,817,971.00.
City and Consultant executed Professional Services Supplemental Agreement No. 3 for Design and Bid Phase Services on December 19, 2018 modifying the scope and increasing by $29,155.00 the amount payable under the Agreement for a total of $3,847,126.00.
City and Consultant executed Professional Services Supplemental Agreement No. 44 for Design and Bid Phase Services on May 24, 2019 modifying the scope and increasing by $44,485.00 the amount payable under the Agreement for a total of $3,891,611.00.
Pflugerville City Council approved Professional Services Supplemental Agreement No. 5 modifying the scope to add Construction Phase and Post Construction Engineering Services and increasing by $1,309,800 the amount payable under the Agreement for a total of $5,201,411 at the October 22, 2019 meeting.
City and Consultant executed a Supplemental Agreement No. 6 for Professional Services on the January 19, 2021 modifying the scope and increasing by $18,566 the amount payable under the Agreement for a total of $5,219,977.
Pflugerville City Council approved Professional Services Supplemental Agreement No. 7 for Professional Services for Design Phase Services for Phase II of the project increasing by $1,528,933 the amount payable under the Agreement for a total of $6,748,910 at the April 27, 2021 meeting.
City and Consultant executed a Supplemental Agreement No.8 for Professional Services on September 29, 2021 modifying the scope and increasing by $0 the amount payable under the Agreement for a total of $6,748,910.
Pflugerville City Council approved Professional Services Supplemental Agreement No. 9 for Professional Services for extension of Construction Phase Services of the project increasing by $114,964 the amount payable under the Agreement for a total of $6,863,874 at the August 9, 2022 meeting.
City and Consultant executed a Supplemental Agreement No. 10 for Professional Services on October 17, 2022 modifying the scope and increasing by $49,227 the amount payable under the Agreement for a total of $6,913,101.
City and Consultant executed a Supplemental Agreement No. 11 for Professional Services on January 5, 2023 modifying the scope and increasing by $9,564 the amount payable under the Agreement for a total of $6,922,665.
