Approving an ordinance on second reading with the caption reading: an ordinance of the City of Pflugerville, Texas amending the City of Pflugerville, Texas code of ordinances Title XV land usage, chapter 151 flood damage prevention, section 151.55 Floodplain Administrator by redesignating the City Engineer or appointee as the Floodplain Administrator; providing that this ordinance shall be cumulative; repealing all ordinances to the extent they are in conflict; providing for severability; and providing an effective date.

Summary

The City of Pflugerville has established Flood Damage Prevention regulations in Chapter 151 of the City Code of Ordinances. The overriding purpose of these regulations is to ensure that communities participating in the National Flood Insurance Program (NFIP) take into account flood hazards, to the extent that they are known, in all official actions relating to land management and use.  The Floodplain Administrator, who is designated and responsible for administering the flood damage prevention regulations, is currently assigned as the Development Engineering Director. In FY19, the Development Engineering Director position was reclassified as an Assistant City Engineer. It is necessary to redesignate the floodplain administrator to a current position. Staff requests the floodplain administrator be assigned to the City Engineer or his/her designee to allow for future flexibility as staff and positions change.

 

The Legislature of the State of Texas has in the Flood Control Insurance Act, Texas Water Code, Section 16.315, delegated the responsibility of local government units to adopt regulations designed to minimize flood losses in accordance with the National Flood Insurance Program (NFIP). The State grants communities the police powers to adopt, administer and enforce local codes and regulations, including floodplain regulations in which generally elected officials delegate authority for ordinance administration and enforcement to a subordinate officer, such as the Floodplain Administrator.

 

The city voluntarily participates in the National Flood Insurance Program (NFIP) which enables property owners to obtain flood insurance policies to complement their homeowner's or renter's insurance policies. For a community to participate in the National Flood Insurance Program, it must adopt and enforce floodplain management regulations that meet or exceed the minimum NFIP standards and requirements.

 

Prior City Council Action

Ordinance number 1242-16-01-26 appointing the Development Engineering Director as the Floodplain Administer was approved by City Council at the second reading on January 26, 2016.

 

This ordinance was approved on first reading on April 28, 2020.
