Title

Approving a resolution of the City Council of the City of Pflugerville, Texas, authorizing the acceptance, in accordance with City Parkland Dedication requirements and by Special Warranty Deed, of certain real property described as Lot 4 and Lot 5 (1208 and 1209 Rauscher Dr), Pflugerville Farms Apartments, a subdivision in Travis County, Texas, recorded in Document No. 202000161 of the Official Public Records of Travis County, Texas, and directing the City Manager and City Attorney, or their respective designees, to take all necessary actions to complete the land conveyance to the City.

Summary

Per Section 4.01 (c) 10 of the City Charter, if authorized by the City Council, the City Manager may sign any contract, conveyance or other document. The Pflugerville Farms Planned Unit District (PUD) was approved in June 2019 and amended in July 2023.  The PUD documents and subsequent amendment governs the development of the Pflugerville Farms Apartments Subdivision.  The subject property, described as Lot 4 and 5, Pflugerville Farms Apartments Subdivision was platted in 2020 and was designated as an open space, public drainage easement, and public parkland lots and is approximately 8.322 acres. The addresses for these lots are 1208 and 1209 Rauscher Dr.

 

Per Subchapter 14 Parkland Standards, Section 14.3.6 of the Unified Development Code, parkland shall be conveyed by general or special warranty deed with acceptable evidence of clear title, and the developer shall provide a title policy and pay all costs of transferring title to the City.

 

On June 11, 2024, City Council approved a 3-year maintenance agreement with the developer.

Recommended Action
