The property is approximately 19.86 acres and is currently subject to a Chapter 43 Non-Annexation Development Agreement executed in 2008. The site is located at the northeast corner of Weiss Lane and Wolf Pack Drive, south of the City’s water treatment plant.
The proposed project includes a minimum of two acres of commercial development, with the remainder of the property proposed for multifamily residential development. Shared detention would be provided on the residential portion of the property. If approved, the project would include a horizontal mix of commercial and residential uses, including a gas station with a convenience store, a restaurant, and multifamily residential development.
The proposed Development Agreement establishes the terms for future development prior to the annexation and zoning of the property. It would allow the property owner to retain certain property rights that would otherwise have been available had the property owner not agreed to voluntary annexation in 2008.
Summary of the Development Agreement
1. The amendment proposes to change the future land use designations adopted in the Aspire 2040 Plan for the property from “Neighborhood Retail/Office/Commercial” to “Mixed-Use Commercial” for the Commercial Tract and “Mixed-Density Neighborhood” for the Residential Tract.
The proposed designations would allow commercial development similar to what is permitted under the existing designation while providing additional housing options that are not traditional vertical mixed-use development, ranging from townhomes to garden apartments.
While staff is amenable to the proposed change, there is a separate public process for a Comprehensive Plan Amendment. Staff recommends that the Development Agreement state that the City and Owner agree to process a Comprehensive Plan Amendment, similar to the language addressing the annexation and zoning applications.
The primary concern is that approving the Comprehensive Plan Amendment through the Development Agreement would bypass the established public process that would otherwise apply to the same request.
2. The Development Agreement also includes language consenting to the annexation and zoning of the property to the base zoning districts of GB-1 and R. The annexation and zoning applications would be submitted separately.
The Unified Development Code (UDC) allows multifamily development within the GB-1 District subject to MF-20 development standards, which are also reflected in the proposed agreement. However, the applicant is requesting several deviations from the UDC.
The requested deviations would:
a. Remove the requirement for commercial uses on the ground floor;
b. Remove the minimum dwelling unit size requirement;
c. Remove the requirement for a mix of unit types;
d. Modify setbacks adjacent to single-family residential development; and
e. Remove the requirement for garage parking. Instead of providing one garage for every two units, the project would be required to provide only surface parking.
As a trade-off and enhanced development standard, all buildings containing ground-floor residential uses would be required to have their primary facades facing Wolf Pack Drive.
The applicant's basis for these requests is that the narrow configuration of the lot does not provide adequate space to develop the property in accordance with the adopted multifamily development standards. A comprehensive list of the requested code deviations is included as an attachment to this report.
3. Parkland requirements would be satisfied through a fee-in-lieu, consistent with the approach typically used for smaller development projects.
4. Driveways along Wolf Pack Drive may have to have approval from Pflugerville ISD, there is an access easement and it appears there is a small portion of ISD property that lies between the subject property and the easement that would need to be crossed. Staff is recommending language to require the approval if, during the subdivision process, it is determined the preliminary tract boundary research is correct.

Recommended Action
Staff is recommending approval of a resolution development agreement between the City of Pflugerville and the Estate of Irby Max Ford and authorizing the City Manager to execute the same with the condition the property is subject to a separate Future Land Use Map Amendment and a section is added to the Development Agreement requiring approval authority should it be required after the ownership parcels are surveyed.
