Title
Approving an ordinance on second reading with the caption reading: AN ORDINANCE OF THE CITY OF PFLUGERVILLE, TEXAS, AMENDING CHAPTER 152 OF THE CITY OF PFLUGERVILLE, TEXAS CODE OF ORDINANCES REGARDING THE IMPACT FEE ORDINANCE;  AND PROVIDING AN EFFECTIVE DATE.
 
Summary
The City of Pflugerville utilizes water and wastewater impact fees to insure that new development assumes a portion of the cost of growth and development within the utility system.  The proposed fees are assessed based on the water meter size for new residential and commercial construction, and a door count for new multifamily development.  The revenue is typically collected upon the issuance of a building permit.
 
Chapter 395 of the Texas Local Government Code establishes the framework for the establishment of impact fees. Sec. 395.047 requires the City to update the land use assumptions and capital improvements plan (CIP) at least every five years.  City staff has worked with Lockwood, Andrews, and Newnam, Inc. (LAN) to revise the current impact fees.
 
Capital Improvements Advisory Committee Action
On May 5, 2014, City staff suggested an impact fee rate schedule to the Capital Improvements Advisory Committee (CIAC). The CIAC accepted the staff suggestion for the impact fee rate schedule and recommended approval and adoption of the proposed rates to the City Council.  Staff recommended a water impact fee of $3,275, a central wastewater basin impact fee of $2,725 and a Cottonwood wastewater basin impact fee of $3,537.  After deliberation, the City Council voted to approve the maximum allowable impact fees of $4,241 for water, $2,725  for the central wastewater basin, and $3,537 for the Cottonwood wastewater basin.  A comparison of the existing fees and maximum allowable fees are included as an attachment to this agenda item.
 
Deadline for City Council Action
This ordinance must be approved within 30 days of the public hearing held on May 27, 2014.
 
Prior City Council Action
On May 27, 2014, a public hearing was conducted and an ordinance was introduced to the Council for a first reading.  Action taken by the Council included amending the proposed rate to the maximum allowable impact fees allowed by law. The land use assumptions and CIP were adopted by the City Council on March 25, 2014. The proposed impact fee rate schedule showing the maximum allowable impact fees is attached to this agenda item.
 
Fiscal Impact
The City will realize a net positive fiscal impact if the ordinance is adopted.  
 
Staff Recommendation
Staff recommends approval of this ordinance with an effective date of July 1, 2014.
