Title

Farley Survey, Abstract 288, Travis County, Texas, and being a portion of Russell Street, also known as 1st Street, in the City of Pflugerville, Texas; Authorizing the City Manager to execute any documents necessary; providing that this Ordinance shall be cumulative; repealing all Ordinances to the extent they are in conflict; providing for severability; and declaring an effective date.

 

Summary

This ordinance allows for discussion and potential action regarding release of public right of way along Russell Street, in exchange for a future transfer of a corner segment at Grant Ave. and Caldwells St. related to the Historic Colored Addition Infrastructure Improvement Project.

The Historic Colored Addition Infrastructure Improvement (Project) will replace deteriorated infrastructure by the removal and reconstruction of the existing subdivision roadways, new water mains with fire hydrants to meet the fire code and provide fire protection of the subdivision. installation of street lighting.

 

In order to provide public safety and fire protection, adequate turning movement for fire apparatus is required.  The turn movement to access Grant Avenue from Caldwells Lane requires an increased turning radius for fire apparatus. As part of the project, it is necessary for the City to acquire this small triangular parcel.  City staff and the property owner have met and discussed several options and arrived at an agreeable solution.  The property owner has requested land transfer of the corner segment in exchange for an equal area of right of way along Russell Street. This agreement has resulted from numerous communications and meetings with Staff, City legal counsel and the City’s land acquisition consultant.

This ordinance authorizes the City Manager to release right of way along Russell Street as previously stated.  In a future transaction the corner segment at Grant Ave. and Caldwells St. will be deeded to the City by the property owner.

 

Prior City Council Action

City Council approved Resolution Number 1693-19-04-09-0600 regarding the Infrastructure and Land Use Study associated with the Pflugerville’s Historic Colored Addition Subdivision on April 9, 2019.

 

City Council approved a Professional Services Agreement with Halff Associates, Inc. in the amount of $233,890 for professional services for the Plans, Specifications, and Estimate (PS&E) associated with the Russell Street, Caldwells Lane, Taylor Street, and Lincoln Avenue Project at the February 25, 2020 meeting.

 

City Council approved a Professional Services Supplemental Agreement with Halff Associates, Inc. in the amount of $175,159 for professional services for continued utility coordination services, bid and construction phase services and construction materials testing associated with the Russell Street, Caldwells Lane, Taylor Street, and Lincoln Avenue Project at the July 27, 2022 meeting.

 

City Council approved authorization to initiate eminent domain proceedings September 27, 2022. For acquisition of corner clip at Grant Avenue and Caldwells St. of Lot 7, Block F, of the Historical Colored Addition situated in Pflugerville, Travis County, Texas.

 

City Council approved the ordinance on first reading on April 11, 2023.
