Summary
This ordinance provides flexibility to reduce temporary certificate of occupancy (TCO) renewal fees when applicants demonstrate substantial progress toward obtaining a final certificate of occupancy.
The ordinance establishes criteria to qualify as substantial progress: completion of major life-safety systems, timely inspections, continuous work with no extended stoppages exceeding 30 consecutive days, only minor finish-out work remaining, and good-faith compliance with city requirements. The ordinance clarifies that site clearing, material storage, or work performed solely to maintain permit status does not constitute substantial progress.
A TCO may be granted when a building is substantially complete and safe for limited use, though minor non-life-safety items remain outstanding. The City currently allows three TCO types: (1) Fixtures, Furniture, and Equipment (FFE), (2) FFE and Training, and (3) Operational TCO. All types require life-safety compliance, with progressively more approvals needed as occupancy increases from initial furniture installation to full public access. Each TCO is valid for 30 days and is considered a separate approval period.
Under the current fee structure, the first TCO costs $100, the second costs $250, and each subsequent renewal doubles the previous fee. If approved, this amendment would allow the City Manager to provide for TCO renewal fees at a minimum of $500 per month when the applicant meets the substantial progress criteria, rather than continuing to double fees until a final certificate of occupancy is approved.
