Discuss and consider action to approve a resolution of the City Council of the City of Pflugerville, Texas, declaring the public purpose and necessity to acquire multiple property interests from different property owners pertaining to the same capital improvement project of the City: an approximate 0.666-acre and 0.387-acre water line easements and 1.394-acre and 0.909-acre temporary construction easements; each located in the John Davis Survey No. 13, Abstract 231, and being out of the remainder of a called 81.15 acre tract, with an address of 1200 E. Pflugerville Parkway and generally located between SH 130 and Dessau Rd; and an approximate 1.029-acre water line easement and 1.607-acre temporary construction easement, both located in the John Davis Survey No. 13, Abstract 231, and being out of a called 20.024 acre tract, and generally located between SH 130 and Dessau Rd; all such properties in the City of Pflugerville, Travis County, Texas; the acquisitions being required to support the City’s construction of a 30-inch waterline along the west side of SH 130 from Pflugerville Parkway to FM 685; and authorizing the City Attorney to proceed with activities necessary to acquire said properties, including institution of condemnation proceedings to acquire the necessary land rights through the use of the City’s eminent domain authority.
Summary
This resolution has been included on the agenda to follow for discussion and potential action regarding water line easements and temporary construction easements (Parcels 2, 2.1 & 3) needed for the 30-Inch SH 130 and Pfluger Farm Lane Water Lines Project WA2202. The City has determined a public need to acquire water line easements and temporary construction easements for the purpose of a 30-inch water line along the west side of State Highway 130 north of Pflugerville Parkway to FM 685. This includes a 30-inch water line along Town Center Drive and crossing State Highway 45, providing a means to fill the ground storage tank from the central pressure zone.
Unfortunately, property owners have not been agreeable to the cost and/or the terms outlined in the water line easements and temporary construction easements proposal. Staff and the City’s land acquisition consultant, 7 Arrows Land Staff LLC, have conducted discussions with the property owners regarding the water line easements and temporary construction easements terms. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process and allow the project to move forward.
Approval of this resolution authorizes the City Manager and the City Attorney, on behalf of the City, to initiate condemnation proceedings and take all actions necessary to acquire the property through the exercise of eminent domain.

Prior City Council Action
City Council approved the selection of Walker Partners, LLC for professional services associated with SH-130 waterline project and authorized the City Manager to execute a professional services agreement in the amount of $648,788 on August 9, 2022.
City Council approved a work authorization with Seven Arrows Land Staff, LLC in the amount of $278,800 for right-of-way and appraisal services with the SH 130 Waterline Project on August 27, 2024.
City Council approved a professional services supplemental agreement with Walker Partners, LLC in the amount of $957,358 for professional services associated with the SH 130 Waterline project on November 12, 2024.
City Council approved all action necessary to secure right-of-entry and access to real property for the purpose of conducting a survey and any other testing as needed for the 30-Inch SH 130 waterline project on March 25, 2025.
