Conduct a public hearing to receive public comment regarding the proposed land use assumptions and capital improvement plan (CIP) for use in revising Pflugerville's water and wastewater impact fees.
Summary
The purpose of the hearing is to consider the land use assumptions and CIP under which an impact fee may be imposed. Any member of the public has the right to appear at the hearing and present evidence for or against the proposed land use assumptions and CIP. Please find the attached Engineering Report and Capital Improvements Plan for Implementation of Water and Wastewater Impact Fees.
The City of Pflugerville utilizes water and wastewater impact fees to insure that new development assumes a portion of the cost of growth and development within the utility system. Chapter 395 of the Texas Local Government Code establishes the framework for the establishment of impact fees. Sec. 395.042 requires the City to update the land use assumptions and CIP at least every five years.
City staff has worked with Lockwood, Andrews, and Newnam, Inc. (LAN) to revise the land use assumptions and CIP as required by Chapter 395 of the Texas Local Government Code.
Status
As required by Chapter 395 of the Texas Local Government Code, a Water and Wastewater Impact Fee Study considering the capital improvements included in the water and wastewater master plans, adopted by the City Council on January 28, 2014, has been completed.
Staff presented the studies' land use assumptions, updated fees and schedule for adoption to the Capital Improvements Advisory Committee (CIAC) at its February 3, 2014 meeting, and will meet again with the CIAC in April for comments and feedback.
Previous City Council Action
At their regular meeting on February 11, 2014, the City Council approved a resolution setting a March 25, 2014 public hearing date to receive public comment regarding the proposed land use assumptions and CIP for revising Pflugerville's water and wastewater impact fees. The resolution provided for a 30-day publication notice for a public hearing to be set for the City Council's March 25, 2014 meeting. The resolution is attached.
Deadline for City Council Action
The Water and Wastewater Impact Fee Ordinance is planned for adoption by the City Council on May 27, 2014.
Projected Future City Council Action
Following further consideration by the Capital Improvement Advisory Committee (CAIC) on April 7, the City Council will consider their final report regarding the land use assumptions on April 8. At that time, the Council will also consider a resolution setting the date of the public hearing for the adoption of impact fees anticipated for May 27. Based on this schedule, the effective date for the new fees is proposed to be July 1, 2014.
Fiscal Impact
The City will realize a net positive fiscal impact if the ordinance is adopted.
