Summary
IDIL Springbrook Commerce Center (“IDIL”) has submitted plans to the City of Pflugerville to build an industrial complex at 18100 Schultz Lane on the west side of Schultz Lane approximately ¼ mile north of Schultz Lane’s intersection with AW Grimes Boulevard. The site is located within the wastewater service area of SouthWest Water Company (“SWWC”). However, SWWC does not have gravity wastewater lines located adjacent to IDIL’s site. The closest existing SWWC wastewater lines are located at the intersection of Quitman Mountain Way and Pecos River Trail and the elevation of those existing wastewater lines do not allow gravity wastewater lines to be extended to IDIL’s site. IDIL has elected to construct a private wastewater lift station on their site (near the southwest corner of their site) and to extend a private 4-inch diameter force main from their lift station to the existing SWWC gravity wastewater lines at the intersection of Quitman Mountain Way and Pecos River Trail. The lift station and force main will be privately owned and maintained.
The force main will be on private property for much of its alignment, but will be installed within AW Grimes Boulevard right-of-way (aligned parallel to the road) for a few hundred feet and will cross AW Grimes Boulevard to Pecos River Trail. The force main will also be aligned along Pecos River Trail to Quitman Mountain Way at which point it will connect to existing SWWC gravity wastewater lines.
The crossing under AW Grimes Boulevard will be completed by trenchless boring operation within a casing pipe so the work to install the wastewater line under AW Grimes Boulevard will not impeded traffic. The casing pipe will also allow the force main to be withdrawn from the casing pipe if needed for future repairs without disruptions to AW Grimes Boulevard traffic. There will be traffic restrictions on Pecos River Trail and on Quitman Mountain Way during the initial force main construction, but access to all properties will be maintained and proper traffic control and notice to residents will be provided.
The license agreement is the mechanism whereby IDIL is permitted to have a private force main in City right-of-way. The license agreement specifies that the force main is privately owned and maintained. The license agreement requires them to respond in a prompt manner to any maintenance issues that arise with the force main. The license agreement also preserves the City’s right to require IDIL to relocate the private force main elsewhere within the City’s right-of-way if the City needs them to do so in order to exercise our rights for right-of-way management. For example, if the City needed the alignment/location of the force main for a future publicly-owned City utility (e.g., a proposed waterline), the City could require IDIL to relocate to a different location within the AW Grimes Boulevard right-of-way at their cost. The force main is small enough in size that locating another acceptable running alignment for the line should be easily achievable. The license agreement also requires IDIL to remove their force main from City right-of-way if they no longer need or use the force main. They are also required to remove the force main from City right-of-way if they are found to be in default of the agreement.
