Summary
This agenda item is a request for City Council approval of a Local On-System Agreement (LOSA) with the State of Texas Department of Transportation (TxDOT) to add a right turn lane on SH 45 to the proposed Pfluger Farm Lane project. TxDOT has already approved the authorization for City to process the LOSA, as City must provide an approved resolution for TxDOT to execute the LOSA. For the proposed LOSA, the City will be required to provide payment in the amount of $11,099 to TxDOT for direct and indirect costs as fees for the project, which is a minimal amount required by TxDOT. This item is supported by the Infrastructure pillar of the Strategic Plan.
The right turn lane at SH 45 (“Project”) is an element of the Pfluger Farm Lane project funded by the 2020 Transportation Bond Program. The Pfluger Farm Lane Right-of-Way was dedicated to the City by LC Pflugerville, LLC (owner) as documented in the City/Owner Agreement executed on December 21, 2020.
The Texas Department of Transportation requires approval of a Resolution and execution of a Local On-System Agreement (LOSA) prior to authorizing the City to perform work within the State’s right of way. The LOSA is used by TxDOT for construction projects within State right of way when the local government proposes to perform and fund all elements of the project. TxDOT approval grants the City of Pflugerville the ability to work within the State right of way to construct the right turn lane on SH 45.
City staff has been coordinating with the TxDOT North Austin Area Office on the project for reviews of approval of the project plans and specifications prior to authorization of work. The City will be required to obtain TxDOT approval prior to letting, selection of the contractor and award of the construction contract for the project. The current project schedule, as provided to TxDOT with the LOSA, has a proposed letting date in April 2023. Refer to the attached agreement and schedule for more details.
Approval of the Resolution for the LOSA will authorize the City Manager to execute the LOSA, which will be provided to TxDOT to approve the proposed improvements prior to commencement of construction. The City will be required to obtain TxDOT approval prior to selection of the contractor and award of the construction contract for the project. City Staff will review the project to develop a bidding schedule upon receipt of TxDOT approval.
Prior City Council Action
City Council approved a professional services agreement with Kimley-Horn and Associates, Inc. in the amount of $349,995.80 for professional engineering services associated with the Pfluger Farm Lane on January 19, 2021.
City Management Office approved a professional services supplemental agreement #1 with Kimley-Horn and Associates, Inc. in the amount of $23,370.00 for subsurface utility engineering services associated with the Pfluger Farm Lane on May 18, 2022.
