A Resolution of the City Council of the City of Pflugerville, Texas, declaring the public purpose and necessity to acquire an approximate 0.0331- acre (1,433 sf) drainage easement; located in the John Davis Survey No. 13, Abstract 231; and generally located adjacent to and south of E. Pflugerville Parkway and west of Becker Farm Road; in the City of Pflugerville, Travis County, Texas; the acquisition being required to support the City’s construction of the E. Pflugerville Parkway (Colorado Sand to Weiss) Project; and authorizing the City Attorney to proceed with activities necessary to acquire said properties, including institution of condemnation proceedings to acquire the necessary land rights through the use of the City’s eminent domain authority.
Summary
This resolution has been included on the agenda to follow for discussion and potential action regarding a drainage easement (Parcel 16) needed for the East Pflugerville Parkway (Colorado Sand to Weiss) Project TR2005; with an appraised amount of $15,422. The City has determined a public need to acquire drainage easement for the purpose of widening the roadway to a four-lane urban section including new traffic signals, lighting, a shared use path, and improvements to utilities and drainage infrastructure.
Although offer was discussed and agreed upon, no binding agreements were ever executed, since property owner wanted to come to an agreement on both parcels in this project, the transaction did not proceed. City legal counsel and City’s land acquisition consultant, Lockwood, Andrews & Newman, Inc have conducted discussions with the property owner regarding the drainage easement terms. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process since construction of this project commenced on July 20, 2026.
Approval of this resolution authorizes the City Manager and the City Attorney, on behalf of the City, to initiate condemnation proceedings and take all actions necessary to acquire the property through the exercise of eminent domain.

Pflugerville Parkway (Colorado Sand to Weiss Lane) project in the amount of $82,980 on May 13, 2025.
City Council approved conditional purchase agreement and associated conveyance documents between PFPE23 Farms, LLC (Parcel No. 3) and City of Pflugerville as necessary to acquire real property interest for the E. Pflugerville (Colorado Sand to Weiss) in the amount of $599,000 on March 24, 2026.
City Council approved a construction contract with Patin Construction, LLC in the amount of $12,572,533 for construction services associated with TR2005- East Pflugerville Parkway (Colorado Sand Drive to Weiss Lane) Roadway Project on April 14, 2026.
