Title

Approving an ordinance on second reading with the caption reading: An Ordinance of the City of Pflugerville, Texas authorizing the execution of a tax resale deed for the conveyance of property Lot 23, Block B, Spring Brook Phase A Section 1-G, Plat Number 200100112 as described in Document number 2008036125 of the deed of records of Travis County, Texas; Providing for Severability; and Providing an effective date. 

 

Summary

The City recently received a notice and a Tax Resale Deed from Travis County requesting the City to execute the Tax Resale Deed.   Section 34.05 of the Tax Code allows a taxing unit to sell property it obtained under a Tax Judgment if each taxing unit entitled to receive proceeds of the sale under the Tax Judgment consents to the sale. After financial review, there is very minimal financial impact on the City.  The subject tract is located in Springbrook Subdivision on Catamut Drive and was dedicated at the time of subdivision as an access and storm sewer easement.  Sale of this property does not remove the easement.

 

Each month Travis County offers properties for sale at our monthly tax foreclosure sale at the courthouse steps.  These properties are being sold because delinquent property taxes have not been paid by the owner.   If no one purchases the property at the tax foreclosure sale, then the property is placed in trust with Travis County and offered for sale on the tax resale list.

 

In this case, a bid was received for the property on Catumet Drive.  At the August 31, 2021 Commissioners Court meeting, the bids for all of the properties on the Consent Items Chart were accepted.   The tax resale deeds were prepared by the County Attorney’s Office and sent to the County Judge to sign first.  After the County Judge signs the deeds, then each of the taxing entities must sign off on the deeds as well.  Once all of the signature pages from all of the taxing entities are received, then the deed is recorded in the name of the purchaser.    

 

Travis County collects property taxes for a variety of taxing entities including the City of Pflugerville, Pflugerville ISD, Travis County Healthcare District and Travis County Emergency Services Dist. No. 2.   A portion of the tax resale purchase price will go to each of the taxing entities to pay the taxes owed to that entity.  

 

Legal has approved the ordinance.
