Summary
This agenda item requests approval of a professional services supplemental agreement (PSSA) with Freese and Nichols, Inc. in the amount of $99,897 for construction phase and post-construction phase services associated with the Central Wastewater Treatment Plant Expansion Phase I Project. This item supports the Infrastructure Pillar of the Strategic Plan.
Phase I of the Central WWTP Expansion began construction on October 19, 2019. FNI’s scope of services for the Construction Phase was originally authorized in Professional Services Supplemental Agreement No. 5 (PSSA No. 5) and was developed based on a construction duration of 24 months, with Substantial Completion scheduled for October 12, 2021. Change Order Numbers 1 through 5 between the CITY and the construction contractor extended the construction contract to a revised Substantial Completion date of April 20, 2022. FNI agreed to work through the revised April completion date under the existing fee from PSSA No. 5. Since the execution of Change Order No. 5, construction was further delayed, and FNI’s Construction Phase Services were extended to February 2023 under PSSA No. 9 and then to November 2023 under PSSA No. 12.
FNI completed a punchlist walkthrough of the site in December of 2023 and issued a letter to the Contractor on January 26, 2024, recommending that Substantial Completion not be awarded. FNI provided a punchlist with the letter that indicated construction items that need to be completed to achieve Substantial Completion and other items that need to be completed to achieve Final Completion. As of the date of this contract, Substantial Completion for the Project has not been achieved. The Basic Services included in this supplemental agreement extend FNI’s Construction Phase Services from PSSA No. 12 an additional 13 months to December 2024. This supplemental agreement also includes effort to assist the City and Contractor with miscellaneous Warranty Items that may arise during this period.

• Maintenance of project documentation system
• Construction Coordination
• Attendance at monthly meetings
• Specialty observation site visits
• Operations and warranty phase support for facility
Prior City Council Action
On March 30, 2017, the City Council approved a Professional Services Agreement with Freese and Nichols, Inc in the amount of $375,806 for study and planning phase services associated with the Central Wastewater Treatment Plant Expansion Phase I.
On March 2, 2018, the City Council approved a Professional Services Supplemental Agreement No. 1 with Freese and Nichols, Inc. in the amount of $3,442,165 for design and bid phase services associated with the Central Wastewater Treatment Plant Expansion Phase I.
On November 1, 2019, the City Council approved a Professional Services Supplemental Agreement No. 5 with Freese and Nichols, Inc. in the amount of $1,309,800 for construction and post construction engineering services associated with the Central Wastewater Treatment Plant Expansion Phase I.
On May 4, 2021, the City Council approved a Professional Services Supplemental Agreement No. 7 with Freese and Nichols, Inc. in the amount of $1,528,933 for design phase services associated with the Central Wastewater Treatment Plant Expansion Phase II.
On September 26, 2022, the City Council approved a Professional Services Supplemental Agreement No. 9 with Freese and Nichols, Inc. in the amount of $114,964 extending constructions phase services associated with the Central Wastewater Treatment Plant Expansion Phase I.
On May 16, 2023, the City Council approved a Professional Services Supplemental Agreement No.12 with Freese and Nichols, Inc. in the amount of $135,593 extending constructions phase services associated with the Central Wastewater Treatment Plant Expansion Phase I.
