Title

Approving a license agreement with Jazz Street Investments LLC for landscape and irrigation improvements within the City's right-of-way as part of the Cielo North Phase 2 development, in accordance with Chapter 96 Right-of-Way Management, Division V, and authorizing the City Manager to execute the same.

 

Summary

The Cielo North Phase 2 Subdivision is located on the far northwest side of Pflugerville, generally located north of Pflugerville Parkway, east of Greenlawn Blvd., and east of Jazz Street. The development is a condominium regime that was developed under the Single-Family Mixed Use Zoning District. The development is mostly served by internal private driveways, but there were two street stubs from the subdivision to the north that were required to be extended as public roads, including Jazz Street, Carousel Drive, and Zydeco Drive. This proposed license agreement is for irrigation and turf grass that was installed in the public right-of-way as part of the development’s public improvement plans. The property owner association will maintain the turf and irrigation as part of the requirements of the license agreement. The proposed improvements were requested by the owner to improve the aesthetic appearance of the project and the adjacent City right-of-way. Cielo North Phase 1 also has a license agreement for the same improvements that were included in the right-of-way of Jazz Street along the east side of the street, so the proposed improvements also match the aesthetic that was previously approved.

As part of the agreement, it will be the owner’s responsibility to maintain and repair the improvements. They are also required to relocate the improvements should the city need access to the area subject to this proposed license agreement.

The proposed improvements will not conflict or interfere with the City’s use of the right-of-way.
