Approving a resolution adopting the receipt of electronic bids and proposals in accordance with the Texas Local Government Code. 

 

Summary

Texas State Government Code Chapter 252 requires expenditures over $50,000 comply with competitive sealed bidding or proposal process, with few exceptions.  City of Pflugerville’s current procurement process for non-professional services over $50,000 utilizes a method for receipt of bids from vendors in a hardcopy format, which is not as efficient as an electronic bid format.  Staff has reviewed processes and procedures to determine efficiency improvements, as such electronic bidding would benefit to streamline current practices.  An Electronic Bid means bid or part of bid submitted by bidder to the City in electronic format and, as such, it has to be foreseen by tender documents, to meet the principles of electronic business according to special regulations, and to constitute a clear entirety with other parts of the same bidder’s bid.

The Electronic Bid would allow bidder, in response to an advertised invitation to bid, submits all documentation, except for information and documents specified in the invitation to bid, only through an electronic process to an identified secure electronic mail account that will not be opened by the Office or an agency until the close of the bidding period.  In this process, no hard copy documentation shall be submitted to the Office or an agency prior to the award of the contract.

In 2001 the 77th Legislature approved Texas Local Government Code Chapter 252, Section 252.0415 Procedures for Electronic Bids or Proposals.  In order to receive electronic bids, City must adopt rules in conformance with Chapter 252.
