Summary
Staff requests City Council approval of Professional Services Supplemental Agreement No. 7 with Freese and Nichols, Inc. (FNI) in the amount of $352,582.00 for additional construction phase, design, coordination, and project management services associated with the Secondary Colorado River Raw Water Line Project.
The original Professional Services Agreement with Freese and Nichols, Inc. was approved by City Council on February 12, 2022, in the amount of $7,309,766.00. Subsequent supplemental agreements increased the authorized agreement amount to $9,638,302.00 before Supplemental Agreement No. 7.
The project currently has a total budget of $130,112,095, with $110,554,885 expended to date, leaving $19,557,210 in the remaining project budget. Approval of Supplemental Agreement No. 7 would reduce the remaining project budget to $19,204,628.
The project includes improvements to the Colorado River Intake Pump Station (Construction Packages 1 and 2) and approximately 78,000 linear feet of 42-inch water transmission pipeline (Construction Packages 3 and 4). The project will increase the City's capacity to transfer and deliver water supplies from the Lower Colorado River Authority (LCRA).
The Secondary Colorado River Raw Water Line Project supports the Residential and Node Development Pillar of the Strategic Plan.
The additional professional services requested under Supplemental Agreement No. 7 are primarily associated with extended construction schedules, an increased volume of construction submittals and requests for information, additional contractor coordination, and engineering associated with the February 2026 failure of the existing 30-inch water pipeline at Boggy Creek.
The Boggy Creek pipeline failure resulted in additional engineering and coordination related to temporary bypass piping, permanent pipeline repairs, pump station startup, and approximately 75 feet of stream bank stabilization. The pipeline alignment includes three creek locations, and the work associated with the Boggy Creek pipeline failure is separate and unrelated to the scope of Supplemental Agreement No. 6. The project has also required additional engineering services due to contractor installation issues, construction coordination, and submittals requiring more reviews than anticipated under the original agreement.
The extended construction schedules have increased the duration of required construction-phase engineering services. The original completion date for Package 2 was March 15, 2026, with the current conservative estimated completion date of January 15, 2027. Packages 3 and Package 4 originally had completion dates of June 7, 2026, with current conservative estimated completion dates of October 31, 2026.
The additional scope also reflects construction administration beyond the levels anticipated in the original agreement. Package 2 has required 63 requests for information and seven excessive submittal reviews, while Package 3 has required 74 requests for information and nine excessive submittal reviews. Package 4 has required 58 requests for information and six excessive submittal reviews.
Approval of this supplemental agreement will provide the additional professional services necessary to support the successful completion of this critical water infrastructure project.
Prior City Council Action
On February 12, 2022, City Council approved a Professional Services Agreement with Freese and Nichols, Inc. in the amount of $7,309,766 for design and bid phase services associated with the Secondary Colorado River Raw Water Line project.
On October 30, 2023, City Council approved a Professional Services Supplemental Agreement with Freese and Nichols, Inc. in the amount of $72,515 to provide construction phase services associated with Package 1 of the Secondary Colorado River Raw Water Line project.
On April 2, 2024, City Council approved a Professional Services Supplemental Agreement with Freese and Nichols, Inc. in the amount of $1,982,815 to provide construction phase services and easement acquisition services associated with the Secondary Colorado River Raw Water Line project.
On July 17, 2024, City Council approved a Professional Services Supplemental Agreement with Freese and Nichols, Inc. in the amount of $223,306 to provide environmental services associated with the Secondary Colorado River Raw Water Line project.
