Summary
The original Development Agreement regarding the Bohls North and PCDC Tracts was approved in 2005, with subsequent amendments in 2006 and 2009.  The property was recently acquired by a new developer.  The Third Amendment proposes changes to the general layout of the subdivision as reflected in Attachment 1 - Land Plan.  The remaining amendments affect the Sorento Regulating Plan and are reflected in Attachment 2 of the Development Agreement.

Generally, the proposed changes to the Regulating Plan in the Third Amendment include:
·      Change to the minimum lot areas, removing the requirement to allocate 5% of the lots to 9,000 sf and greater and maintaining:
-      a maximum of 75% of the lots to be 6,600 sf minimum,
-      a minimum of 10% for of the lots to be between 7,500-8,399 sf and
-      a minimum of 10% of the lots to be a minimum of 8,400 sf.
·      The front setback has been reduced from 20 to 15 feet for side loaded garage layouts only.
·      Reduction in the side setbacks to allow for 5 feet standard and 10 feet at the street side.
·      Modification of maximum building footprint coverage to reflect the limitations prescribed by the lot setbacks.
-     Allowances for trellises to encroach 10 feet into the rear setback.
·      Specification of architectural elements:
-      roof elevation - modified roof pitch to allow for a range from 2:12 to 5:12 instead of requiring a 5:12 pitch for all homes
-      masonry materials - Primary materials - brick and stone; Primary material with a maximum of 50% - stucco; Accent/decorative material - cementitious siding and wood.
·      Modifications to the graphics providing allowances for side entry garages with all lot designs.
·      Added parking and garage provisions.
·      Added provisions for accessory dwelling units.

A side by side comparison has been provided that redlines the differences between Amendment 2 and Amendment 3.

Staff Recommendation
Staff recommends approval of this amendment as requested.  The proposal allows for the developer to meet the needs of the homebuilders while providing the high quality standards expected by the community.  While this site is within our extraterritorial jurisdiction, the modifications to the established regulations meet the goals of our Comprehensive Plan and the purpose statement of our suburban residential zoning district and ensure high quality design and construction for all housing types.  City building permits are required in Sorento.
