Summary
The proposed amendment is to include an updated service area map to incorporate newly annexed areas as of August 2023 which is reflected in the Roadway Impact Fee Study 2023 Update that was prepared by Kimley-Horn and Associates August 3, 2023. No other amendments are proposed with the ordinance.
The City previously adopted the roadway impact fee ordinance on November 24, 2020 and codified within Chapter 152, Subchapter B of the Code of Ordinances. This ordinance was amended in March 2022 to include an updated roadway impact fee service area map and provisions relating to appraisals for estimating fair market value for the dedication of right-of-way, and approving a Roadway Impact Fee Study 2022 Update.
The rates that became effective January 1, 2023 retain a consistent $1,590 per service unit for residential development across all three service areas, and differing rates for non-residential development per service unit in the three service areas. The roadway impact fees collected for each service area are used to finance or recoup the costs of any roadway improvement or facility expansions identified in the Roadway Impact Fee Capital Improvements Plan for the service area which is included in the Roadway Impact Fee Study 2023 Update. According to Chapter 395 of the Texas Local Government Code, the capital improvements plan and the land use assumptions that establish roadway impact fees are required to be reviewed at least every five years. A request for funding a rate study for roadway impact fees can be anticipated in FY25, following the mobility plan update that will occur in FY24.
